Future work emanating from the report of the Study Group.

At the 2901st and 2902nd meetings of the Commission, on 27 and28 July 2006, the Chairman of the Study Group introduced the report of the Study Group.
In addition to repeating the list contained in the commentary to Draft Article 26, the Report of the Study Group on Fragmentation provides a list of"the most frequently cited candidates" for the status of jus cogens.
With respect to the report of the Study Group, and in particular the question of the"disconnection clause" his delegation did not agree that the effect of both the European Community and its member States becoming parties to the same international treaty was a negative phenomenon or that it led to the fragmentation of international law.
At its 2741st and 2742nd meetings, held on 6 and 7 August 2002,the Commission considered and adopted the report of the Study Group as amended, which is produced in section C below.
He referred, lastly, to the final report of the Study Group on fragmentation of international law, whose 42 conclusions were of great value for States, as they showed how to treat that phenomenon as a positive element of contemporary international law.
In that connection, the view was expressed that the Commission should act on the proposal contained in the report of the Study Group for the organization of a seminar to gain an overview of State practice as well as to provide a forum for dialogue.
It is also envisioned that the final report of the Study Group would address broadly the question of the interpretation of MFN provisions in investment agreements in respect of dispute settlement, analysing the various factors that are relevant to this process and presenting examples of model clauses for the negotiation of MFN provisions, based on State practice.
As regards the topic"Fragmentation of international law:difficulties arising from the diversification and expansion of international law", the Commission considered the report of the Study Group and took note of its 42 conclusions(Chap. XII), which it commended to the attention of the General Assembly.
During the current year, the Commission had taken note of the report of the Study Group, which had established a schedule of work for the period 2003-2006, distributed among its members the work to be undertaken on the remaining recommended studies and decided upon the methodology to be adopted for that work.
It subsequently adopted the report of the study group thus, inter alia, approving the proposed change of the title of the topic from"The risks ensuing from the fragmentation of international law" to the current title, as well as the recommendation that the first study to be undertaken will be on the issue entitled"The function and scope of the lex specialis rule and the question of'self-contained regimes'" Chapter IX.
She was surprised that the Commission had devoted only three meetings to the report of the Study Group on the question of fragmentation of international law and that it had merely taken note of that report, which had been"finalized" by the Chairman of the Group. .

The present report, in accordance with the discussions in the Study Group on Treaties over time at the Commission's sixty-fourth session(2012), synthesizes elements of the three reports of the Study Group and takes into account the discussions within that Group. .
