Noting that Member States have different institutional arrangements and capacities to ensure the implementation of legislation on preventing corrupt practices and transfer of funds andassets of illicit origin and returning such funds and assets to the countries of origin.

At the 38th meeting, on 20 November, the Vice-Chairman of the Committee, Bruno van der Pluijm(Belgium), introduced a draft resolution entitled"Preventing and combating corrupt practices andtransfer of funds of illicit origin and returning such funds to the countries of origin"(A/C.2/57/L.46), which he submitted on the basis of informal consultations held on draft resolution A/C.2/57/L.9.
In its resolution 56/260 of 31 January 2002, the General Assembly requested the Ad Hoc Committee for the Negotiation of a Convention against Corruption, in developing the draft convention, to adopt a comprehensive and multidisciplinary approach and to consider a series of indicative elements, among which were preventing and combating the transfer of funds of illicit origin derived from acts of corruption,including the laundering of funds, and returning such funds.
Requests the international community to support national efforts by, among others, providing technical assistance, strengthening human and institutional capacity to prevent corrupt practices andthe transfer of funds of illicit origin and assets and returning such funds and assets to the countries of origin and formulating strategies for mainstreaming ethics and integrity in both the public and private sector;
The General Assembly had earlier decided, in resolution 58/205 of 23 December 2003, to include in the provisional agenda of its fifty-ninth session a sub-item entitled"Preventing andcombating corrupt practices and transfer of funds and assets of illicit origin and returning such funds and assets to the countries of origin.
Decides to keep the matter under review and to include in the provisional agenda ofits fifty-seventh session a sub-item entitled"Preventing and combating corrupt practices and transfer of funds of illicit origin and returning such funds to the countries of origin" under the item entitled"Sectoral policy questions.

At its fifty-sixth session, the General Assembly decided to include in the provisional agenda of its fifty-seventh session a sub-item entitled"Preventing and combating corrupt practices andtransfer of funds of illicit origin and returning such funds to the countries of origin" under the item entitled"Sectoral policy questions" resolution 56/186.
