Mr. Mukhopadhaya(India): My delegation wishes to explain its vote on resolution 53/164, on the situation of human rights in Kosovo.
The situation of human rights in Kosovo continued to be worrisome and over the past year the number of human rights violations seemed to have increased.
The situation of human rights in Kosovo continues to be characterized by the abduction and arbitrary detention of persons, as well as reports of summary execution of persons detained.
The following resolution of the General Assembly on the matter, Resolution 54/183(of 17.12.1999), again shifted attention to the situation of human rights in Kosovo.
Calls upon the Special Rapporteur to continue to monitor closely the situation of human rights in Kosovo and to continue to pay due attention to this matter in her reporting;
At the 25th meeting, on 9 April 1999, Ms. Mary Robinson, United Nations High Commissioner for Human Rights, made a statement on the situation of human rights in Kosovo.
As a result, specialized information from intergovernmental sources on the situation of human rights in Kosovo was coming principally from United Nations field presences.
The situation of human rights in Kosovo has lately been the subject of continuous attention of the members of the Commission on Human Rights and the international community.
On the basis of that consideration,the delegation of China could not support the draft resolution on the situation of human rights in Kosovo that has just been adopted.

Prior to the adoption by the Security Council of resolution 1244(1999),the General Assembly adopted five resolutions on the situation of human rights in Kosovo resolutions 49/204, 50/190, 51/111, 52/139 and 53/164.
India voted against the resolution on the situation of human rights in Kosovo, but not because India is indifferent to the plight of the Albanian minority in the Federal Republic of Yugoslavia.
Given the importance of the issue andthe fact that this is the only draft resolution of the General Assembly which addresses the situation of human rights in Kosovo, the Albanian delegation will vote in its favour.
The right place to have addressed the situation of human rights in Kosovo would appear to have been in the context of either the omnibus resolution or a separate resolution on the situation of human rights in the Federal Republic of Yugoslavia.
Resolution 52/139 at last reiterated the same encouragement words to the U.N. SecretaryGeneral as previously done in earlier resolutions of the General Assembly on the situation of human rights in Kosovo cf. supra.
