The Contingency margin mobilised in 2017 is offset for EUR 252 million against the unallocated margins under heading 5 Administration;
Draft Amending Budget(DAB) 4/2016 and the accompanying mobilisation of the Contingency margin are approved as proposed by the Commission.
It recalls that the Contingency Margin shall not result in exceeding the total ceilings of commitment and payment appropriations.
Establishment of a budget at this higher level required the activation of the contingency margin(‘a last-resort instrument to react to unforeseen circumstances'(9)).
The Contingency Margin may be mobilised by the European Parliament and the Council in the framework of the budgetary procedure set out in Article 314 TFEU.
The Commission had not made a proposal for a reduction covering the balance of the contingency margin at the time this report was finalised(10).
The mobilisation of the contingency margin, or part thereof, shall be proposed by the Commission after a thorough analysis of all other financial possibilities.
Whereas it has been agreed, in the framework of the negotiations on the 2014-2015 budgets package,to mobilise the Contingency Margin for an amount of EUR 2 818,2 million plus EUR 350 million, i.e. EUR 3 168,2 million;
Contingency Margin: this is a last resort instrument to react to unforeseen circumstances and amounts to 0.03% of the EU's gross national income(GNI).
Therefore, the Parliament accepts a mobilisation of the Contingency Margin, notwithstanding its interpretation that EUR 350 million remains available under the payments ceiling.
Endorses the joint conclusions agreed by Parliament and Council on 8 December 2014 with the view to provide for reinforcements in payments, in the 2014 budget, on a number of budget lines up to a level of EUR 4 246 million,of which EUR 3 168 million will be mobilised through the Contingency Margin for 2014;

The institutions recall that Article 13 of the MFF-regulation stipulates that"Amounts made available through the mobilisation of the Contingency Margin shall be fully offset against the margins in one or more MFF headings for the current or future financial years".
The total use of the Contingency margin in 2017 is EUR 1 176,0 million for heading 3 and EUR 730,1 million for heading 4 for a total amount of EUR 1 906,2 million.

The decision on the mobilisation of the contingency margin for 2017 adopted together with the Amending Letter 1/2017 will be adjusted accordingly.
Taking into account agencies, pilot projects and preparatory actions, the agreed level of commitments is set at EUR 58 584,4 million, leaving a margin of EUR 1 031,6 million under the expenditure ceiling of heading 2,taking into account that EUR 575,0 million are used to offset the mobilisation of the Contingency margin.
Amounts made available through the mobilisation of the Contingency Margin shall be fully offset against the margins in one or more MFF headings for the current or future financial years.
As a consequence, taking into account pilot projects and preparatory actions, the agreed level of commitments is set at EUR 9 394,5 million, leaving a margin of EUR 16,2 million under the expenditureceiling of heading 5, after the use of EUR 507,3 million of the margin to offset the mobilisation of the Contingency margin.
The mobilisation of the contingency margin was justified by the growing level of unpaid claims for the 2007-2013 cohesion policy programmes at end of 2013 amounting to EUR 23,4 billion.
They underlined that the shortage of payment appropriations for 2014, which was the underlying reason for the presentation of Draft amending budget No 3/2014 and the accompanying proposal by the Commission to mobilise the Contingency Margin, excludes a priori the possibility of finding the resources for Draft amending budget No 5/2014 through redeployment.
Recourse to the Contingency Margin shall not result in exceeding the total ceilings of commitment and payment appropriations laid down in the MFF for the current and future financial years.

The Contingency Margin for 2014 is mobilised for an amount of EUR 2 818.2 million plus EUR 350 million in payment appropriations, in line with the joint statement on special instruments as set out in section 3.3 below.
Whereas some delegations in the Council expressed reservations as to the use of the contingency margin in DAB No 3/2014, which is considered by the Parliament to be an unsubstantiated concern and in contradiction with the spirit of the MFF Regulation and the IIA;
