The following are incompatible with the proper functioning of the Agreement in so far as they may affect trade between the Community and Norway:(i)all agreements between undertakings, decisions by associations of undertakings and concerted practices between undertakings which have as their object or effect the prevention, restriction or distortion of competition as regards the production of or trade in goods;
( i) all agreements between undertakings, decisions by associations of undertakings and concerted practices between undertakings which have as their object or effect the prevention, restriction or distortion of competition as regards the production of or trade in goods;
(ii) Agreements between undertakings, decisions by associations of undertakings or concerted practices.
In order to create a level playing field for agreements, decisions by associations of undertakings and concerted practices within the internal market, it is also necessary to determine pursuant to Article 83(2)(e)[EC] the relationship between national laws and[European Union] competition law.….
Article 101(1) prohibits all agreements andconcerted practices between undertakings and decisions by associations of undertakings(4) which may affect trade between Member States(5) and which have as their object or effect the prevention, restriction or distortion of competition(6).

The application of national competition law may not lead to the prohibition of agreements, decisions by associations of undertakings or concerted practices which may affect trade between Member States but which do not restrict competition within the meaning of Article 81(1)[EC], or which fulfil the conditions of Article 81(3)[EC] which are covered by a Regulation for the application of Article 81(3)[EC].
