As part of the evaluation referred to in paragraph 1, the Commission shall assess the feasibility of.
The information that the CSD is to provide to the competent authority for the purposes of the review and evaluation referred to in paragraph 1;
The Commission shall transmit the evaluation referred to in paragraph 1 to the European Parliament and the Council.
The Agency shall provide the Commission with the information necessary to produce the evaluation referred to in paragraph 3.
The scope of the review and evaluation referred to in paragraph 1 shall be that of the requirements of this Directive.
The relevant approval authority shall inform the Commission andthe other Member States of the results of the evaluation referred to in paragraph 1 and the action required of the economic operator.
On the basis of the evaluation referred to in paragraph 1 of this Article, the Commission may make proposals for amendments to this Regulation, as appropriate.
Where appropriate, the Commission shall accompany the evaluation referred to in paragraph 1 with a legislative proposal.
The evaluation referred to in paragraph 2 shall include an assessment of the results achieved by the Competence Centre, having regard to its objectives, mandate and tasks.
The competent authority shall establish the frequency anddepth of the review and evaluation referred to in paragraph 1 having regard to the size, systemic importance, nature, scale and complexity of the activities of the CSD concerned.
At the end of the period of application of this Regulation, but no later than three years after the end of the period specified in Article 1,the Commission shall carry out a final evaluation of the Regulation on the same terms as the mid-term evaluation referred to in paragraph 2 of this Article.
Member States shall determine the extent of the evaluation referred to in paragraph 2, having regard to the size, nature, scale and complexity of the activities of the credit servicer concerned.
The competent authorities of the home Member State shall regularly, andat least once a year, inform the competent authorities of host Member States of the results of the evaluation referred to in paragraph 2, including details of any administrative penalties or remedial measures taken.
On the basis of the evaluation referred to in paragraph 3, every two years the Commission shall present a report to the Council and, if appropriate, make proposals for terminating the transitional period.
The Commission shall report to the European Parliament andthe Council within one year on the outcome of the evaluation referred to in paragraph 1, and shall accompany its report with any appropriate proposals for amendments to this Framework Decision.
When performing the review and evaluation referred to in paragraph 1, the competent authority shall consult at an early stage the relevant authorities referred to in Article 11 concerning the functioning of the securities settlement systems operated by the CSD.
On the basis of the conclusions of the interim evaluation referred to in paragraph 1 of this Article, the Commission may act in accordance with Article 6(7) or take any other appropriate action.
Competent authorities shall establish the frequency andintensity of the review and evaluation referred to in paragraph 1 having regard to the size, systemic importance, nature, scale and complexity of the activities of the credit institution concerned and taking into account the principle of proportionality.
The evaluation referred to in paragraph 4 shall also consider the extension of the definition of'environmental damage' as defined in Article 2(1), and of the scope of this Directive to include damages to human health, in order to also include damages to the air which can have significant health risks.
Member States shall ensure that competent authorities establish the frequency andintensity of the review and evaluation referred to in paragraph 1 having regard to the size,▌ nature, scale and complexity of the activities of the investment firms concerned and, where relevant, its systemic importance, and taking into account the principle of proportionality.
The evaluation referred to in paragraph 2 shall include an evaluation of the socio-economic impact and the funding needs under the policy objectivesreferred to in Article 4(1), within and among the programmes with a focus on a more competitive and smarter Europe by promoting innovative and smart economic transformation and a more connected Europe by enhancing mobility, including smart and sustainable mobility and regional ICT connectivity.
When performing the review and evaluation referred to in paragraph 1, the competent authority shall closely cooperate with the relevant authorities referred to in Article 11 at an early stage concerning the functioning of the securities settlement systems operated by the CSD.
On the basis of the review and evaluation referred to in paragraph 1, the competent authorities shall determine whether the arrangements, strategies, processes and mechanisms implemented by the credit institutions and the own funds held by these ensure a sound management and coverage of their risks.
The Commission shall carry out the evaluation referred to in paragraph 1 in close cooperation with the operators and the user communities of the Copernicus programme shall examine the effectiveness and efficiency of the Copernicus programme and its contribution to the objectives referred to in Articles 2 and 3.
When performing the review and evaluation referred to in paragraph 1, the competent authorities responsible for supervising CSDs which maintain the types of relations referred to in points(a),(b) and(c) of Article 17(6) shall supply one another with all relevant information that is likely to facilitate their tasks.
Member States shall ensure that when carrying out the evaluation referred to in paragraph 2, the competent authorities of the home and host Member States exchange all information necessary to enable them to carry out their respective tasks laid down in this Directive.
When performing the review and evaluation referred to in paragraph 1, the competent authority shall, at an early stage, consult the relevant authorities,in particular concerning the functioning of the securities settlement systems operated by the CSD and, where applicable, the authority referred to in Article 67 of Directive 2014/65/EU.
The evaluations referred to in paragraph 1 shall include relevant statistics on the financial contributions, broken down by Member State.
Eu-LISA shall provide the Commission with the information necessary to produce the evaluations referred to in paragraph 5.
