It results from the case-law that the national judicial authority may in particular ask of the Commission further information which it needs to carry out its control and in the absence of which it could refuse the authorisation.
That body could be an already existing national authority, such as the national competition authority, the supervisory authority established in accordance with Regulation(EU) 2016/679,the national access to documents authority or a national judicial authority.
It is unacceptable that the new head of the National Judicial Authority and the Chief Prosecutor will have the right to assign cases to tribunals, infringing the principle of the right to access to court and to a fair trial.

The full independence of the judiciary,in particular ensuring that the National Judicial Authority, the Prosecutor's Office and the courts in general are governed free from political influence, and that the mandate of independently-appointed judges cannot be arbitrarily shortened;
This should not prevent Member States in cases of extreme urgency from entrusting the tasks of a national judicial authority to a national administrative competition authority acting as a judicial authority or, by way of exception, allowing for such inspections to be carried out with the consent of those subject to inspection.
