In the present Opinion, I shall propose that the Court should dismiss the appeal lodged by DTS.
See above, point 28 of the present Opinion.
The present opinion aims to make improvements and clarifications to a number of points as set out below.
The wording of Article 27(1) is reproduced in part in point 9 of the present Opinion.
Acting on his own initiative, the EDPS has therefore adopted the present Opinion based on Article 41(2) of Regulation(EC) No 45/2001.
As regards other aspects of the Proposal,the EDPS would like to refer to his comments made under Section 4 of the present Opinion.
In this respect,the observations made in the present Opinion, although aimed at the proposal on OTC derivatives, have a more general relevance.
In addition to the essential shortcomings of the Proposal identified above, the main comments of the EDPS in the present Opinion concern the following aspects.
As already recalled in point 41 of the present Opinion, the provisions providing for an exemption from anti-dumping duties must be interpreted strictly.
Nevertheless, he invites the institutions to reflect upon the need to amend the pending proposals in order totake into account the concerns expressed in the present Opinion.
In light of the doubts expressed in the present Opinion, assess the necessity and proportionality of the proposed system of mandatory publication of sanctions.
Reconsider the current assessment of the impact of the secretariat of the European Data Protection Board in terms of financial andhuman resources(see the Annex to the present Opinion, available on the EDPS website).
As I noted in point 41 of the present Opinion, the new public condition must be assessed in relation to the public taken into account by the author when he gave his consent.
That logic is consistent with the objective of the anti-dumping and countervailing duties which,as already pointed out in point 34 of the present Opinion, is to avoid injury to an EU industry and not to punish the infringement of the customs rules.
The present opinion is the first of a series of entwined opinions, which may result subsequently in additional measures being requested for the sites subject of the current opinion. .
While I agree that we need to avoid a situation in which the defendant finds himself sued before a jurisdiction which he could not reasonably have foreseen(recital 16 of the Recast Brussels I Regulation,see point 96 of the present Opinion), that is clearly not the case here.
As an orientation andpreparation for this future debate, the present opinion provides a basic outline of the current situation and the discussion about GMOs, as well as their regulation in the EU.
The legislature- will be able to use an efficient instrument for legislative drafting and the administration of the legislative process, which will deprive them of some of the complex administrative procedures andenable them to focus more closely on the content of the present Opinion.
Since it is impossible, within the bounds of the present opinion, to analyse all the provisions in question, the EESC's intention is to concentrate on those provisions it considers to be of greatest relevance to society.
In that regard, I would recall, however, that the relevant provisions of Bulgarian law are concerned with the protection of workers suffering from one of the illnesses specified in those provisions, not specifically with disabled persons as such(see points 17 and18 and footnote 4 of the present Opinion).
In this respect, conclusions andguidance to applicants as outlined in the present opinion have been integrated into the draft updated Guidance Document of the EFSA GMO Panel for the ERA of GM plants(under public consultation in parallel to this document).
So far as concerns a Member State's‘compl[iance] with the provisions of international law', which is mentioned in the fourth question referred, I would recall that the Court does not have jurisdiction to give a preliminary ruling on such a point of law andthat the wording of that question must be reformulated in that regard(see point 75 et seq. of the present Opinion).
As to the substance, the observations in points 54 to 82 of the present Opinion lead me to conclude that the contested statement cannot be imputed to the Commission or to the ECB and that, in this regard, the General Court did not err in law.
In the present Opinion, the Commission analyses Serbia's application on the basis of the country's capacity to meet the criteria set by the Copenhagen European Council of 1993 and the conditionality of the Stabilisation and Association process.
For the sake of clarity,it might be repeated that as noted above, in point 34 of the present Opinion, a claim relating to a social security matter within the meaning of Article 1(2)(c) of Regulation No 44/2001 is excluded ratione materiae by the fact that it would not enter the scope of that regulation.
In the present Opinion, I shall explain why I believe that Articles 5 and 9 of Regulation No 261/2004 must be interpreted as meaning that circumstances such as the closure of airspace owing to the eruption of a volcano constitute extraordinary circumstances for the purposes of that regulation.
As already mentioned at point 15 of the present Opinion, for 2004, the volume of energy consumed via this system amounted to approximately 22 200 MWh, of which around 3 800 MWh, or 14.6%, was supplied to other undertakings situated at the airport.
The comments made in the present Opinion, although aiming at the OTC derivatives Proposal, are also relevant for the application of existing legislation and for other pending and possible future proposals containing equivalent provisions.
(40) As I have explained in point 91 of the present Opinion, national courts must be able to refer to the Court of Justice for a preliminary ruling questions on the validity of implementing decisions and the compatibility of macroeconomic adjustment programmes with the FEU Treaty, the general principles of EU law and the Charter.
