Principle of sincere cooperation under Article 4(3) TEU.
Breach of the principle of sincere cooperation.
It is assumed that Member States report in good faith,in accordance with the principle of sincere cooperation.
The principle of sincere cooperation laid down in Article 4(3) TEU;
Any action, policy orprocedure under this Regulation shall be guided by the principle of sincere cooperation.

Recourse to such clauses undermines the preliminary ruling procedure provided for in Article 267 TFEU, andis not compatible with the principle of sincere cooperation.
This would be contrary to the principle of sincere cooperation enshrined in the Treaties.
Furthermore, the Commission submits that the Decision should be annulled because it was adopted in violation of the applicable procedural rules and the principle of sincere cooperation.
Indeed, the principle of sincere cooperation also implies that of mutual trust.
(11e) The Commission as guardian of the Treaties should ensure that EU law and the principle of sincere cooperation between Member States are fully complied with.
Whereas the principle of sincere cooperation between the Union Member States is outlined in Article 4 TEU;

At most, the principle of sincere cooperation would oblige the departing State to commence negotiations with the European Union in order to set the terms of withdrawal, although this as an obligation as to conduct, and not as to the result to be achieved.

Some Member States did not comply with the principle of sincere cooperation enshrined in Article 4(3) TEU, since they did not take all appropriate measures, general or particular, to ensure the fulfilment of their obligations.
Until withdrawal, the Member State remains a member of the European Union, with all the rights and obligations that derive from membership,including the principle of sincere cooperation which states that the Union and all its Member States shall assist each other in carrying out the Treaty.
