Shipments of waste destined for recovery 1.
The development of appropriate techniques for the final disposal of dangerous substances contained in waste destined for recovery.

Shipments of waste destined for interim recovery or disposal operations shall be subject to the following additional provisions.

As regards exports of waste destined for recovery in overseas countries or territories, the prohibition set out in Article 36 shall apply mutatis mutandis.
It is also necessary, in order to protect the environment of the countries concerned,to clarify the scope of the prohibition of exports of hazardous waste destined for recovery in a country to which the OECD Decision does not apply, also laid down in accordance with the Basel Convention.
As regards exports of waste destined for recovery in overseas countries or territories not covered by the prohibition set out in paragraph 2, the provisions of Title II shall apply mutatis mutandis.
The targets laid down in Council Directive 1999/31/EC(4) setting landfill restrictions should be strengthened to make them better reflect the Union's ambition to move to a circular economy and make progress in the implementation of the Commission Communication of 4 November 2008 on‘The raw materials initiative: meeting our critical needs for growth andjobs in Europe' by gradually reducing to a minimum landfilling of waste destined for landfills for non-hazardous waste. .
Where waste destined for recovery is shipped through Member States from and to a country to which the OECD Decision applies, Article 44 shall apply mutatis mutandis, with the adaptations and additions listed below.
It will help develop new or improved solutions for the management of radioactive waste, including waste destined for geological disposal, whilst further improving safety aspects and possibly realising economy and efficiency gains, for example in the dismantling of nuclear installations.
Where waste destined for recovery is imported into the Community from countries and through countries to which the OECD Decision applies, the provisions of Title II shall apply mutatis mutandis, with the adaptations and additions listed in paragraphs 2 and 3.

(r) the OECD Decision means the decision of the OECD Council of 30 March 1992 on the control of transfrontier movements of wastes destined for recovery operations.

In March 1992, the Organization for Economic Cooperation and Development(OECD) adopted the OECD Decision on the Control of Transfrontier Movements of Wastes Destined for Recovery Operations.
Both documents are compatible with the Basel Convention( 27),the OECD Decision( 28)(which only covers shipments of wastes destined for recovery operations within the OECD area) and this Regulation, since they take into account the specific requirements set out in these three instruments.
This derogation shall apply only to shipments to countries to which Decision C(2001)107/Final of the OECD Council concerning the revision of Decision C(92)39/Final on control of transboundary movements of wastes destined for recovery operations applies.
