With its insurance services supervision and management system,the insurer is expected to predict adequate steps in order to determine the relevant target market segment for each individual insurance service.
The insurer is expected to regularly re-examine whether an insurance service has been sold to a consumer in the defined target market segment.
The insurance service consumer may file a complaint in writing, at the business premises or through the insurance undertaking's website, by mail, fax or email at the address specified for the receipt of complaints.
The insurer/intermediary is expected to sell that service using a means of communication whose characteristics enable the consumer to be provided with all prescribed information, orall information the consumer needs in order to make a reasonable decision to purchase an insurance service.
If the mediation procedure has been instituted upon insurance service consumer's proposal before filing the complaint with the National Bank of Serbia, the deadline referred to in Section 30 hereof shall not run during the mediation procedure.
The Insurance Law became effective on 27 June 2015, by which time the NBS had adopted 14 supporting decisions1, and the Serbian Government issued a decree2 regulating in detail some of the issues relevant for the pursuit of insurance business. Thus the foundation was laid for the development andimprovement of insurance business and protection of insurance service beneficiaries in the Republic of Serbia.
The insurer is expected not to introduce an insurance service in the market if the testing result for that service indicates that it is not in accordance with the interests, goals and characteristics of the target market segment.
Implementation of the same resale price on the part of all competitors on the relevant market excludes competition,which in turn damages consumers/insurance service users considering that they are disabled from finding products and services of competitive quality and more cost-effective.
By controlling market behaviour of insurance service providers pursuant to the Insurance Law, the National Bank of Serbia shall also supervise such entities' actions with regard to protection of rights and interests of insurance service consumers in accordance herewith.
This decision regulates in detail the manner of protecting the rights and interests of the insured, policyholders,insurance beneficiaries and third injured parties(hereinafter: insurance service consumer), and the manner of mediation in the settlement of claims for damages, complaint filing by the insurance service consumer and the handling of such complaints.
An insurance service consumer may file a complaint to the National Bank of Serbia provided that he had previously filed a complaint in writing to the insurance service provider and was dissatisfied with such provider's response, or the insurance service provider failed to respond in writing to such complaint within the deadline specified herein.
In this sense, the insurer should choose intermediaries with appropriate knowledge, expertise andcapability to properly introduce each insurance service to the market and provide consumers with adequate information about the characteristics and risks of the insurance service, as well as about the services after the conclusion of the insurance contract, if applicable.
An insurance agency undertaking, natural person entrepreneur acting as an insurance agent, as well as a bank, financial lessor and public postal operator that carry on insurance agency activities on the basis of prior approval of the National Bank of Serbia in conformity with law,shall ensure the protection of rights and interests of insurance service consumers, in accordance with the provisions of the insurance contract concluded with the insurance undertaking.
If the complainant is dissatisfied with the response of the insurance service provider or the response is not sent within the deadline set forth herein, the dispute between the insurance service consumer and the insurance service provider may be resolved through out-of-court settlement- mediation.
An insurance undertaking, insurance brokerage undertaking, insurance agency undertaking, natural person- entrepreneur who is an insurance agent, as well as a bank, financial lessor and public postal operator that carry on insurance agency activities on the basis of prior approval of the National Bank of Serbia in conformity with law are obliged to ensure the right to information andprotection of rights and interests of insurance service consumers, in accordance with the Insurance Law( hereinafter: Law) and this Decision.
In the final response referred to in paragraph 1 hereof,the National Bank of Serbia shall indicate to the insurance service consumer the option of out-of-court settlement of the dispute with the insurance service provider through the mediation procedure, provide information on such procedure and point out that the conduct of such procedure is not subject to payment of any fees.
