Register of payment institutions 2.
Payment institutions may result in payment accounts used exclusively for payment transactions.
For the purpose of this Decision, institution shall imply payment institutions and electronic money institutions 2.
Most payment institutions(77%) were owned by one or more natural persons.
Domestic legal and natural persons had a qualifying holding in the capital of 11 payment institutions, and foreign legal andnatural persons in two payment institutions.
Payment institutions may use payment accounts held with them only for the execution of payment transactions.
Competition in the field of payment services provision has increased- today, in addition to banks,13 payment institutions and two electronic money institutions operate in our market.
The Law introduces payment institutions and electronic money institutions and governs their operations.
The Bank shall not be liable for any damage caused by circumstances beyond its control blackouts, ATM breakdowns,omissions and/or failures to act by other banks, payment institutions or merchants, etc.
At end-2018, 13 payment institutions and one electronic money institution operated in Serbia, which also provided payment services through the network of 2,263 agents(vs. 1,359 in 2017).
The Bank shall not be liable for damage caused by circumstances that it cannot influence(power failure, failure of ATMs,omissions and/or inaction by other banks, payment institutions and retailers, etc.).
After receiving the licence for provision of payment services,the above entities will be able to register as payment institutions, in a procedure prescribed by the Law, by submitting a registration application to the Business Registers Agency.
The register of payment institutions shall contain data on: 1 payment institutions licensed by the National Bank of Serbia to provide payment services; 2 agents of payment institutions in the Republic of Serbia; 3 branches of payment institutions in third countries.
In more practical terms this also includes the avoidance of informal transfer mechanisms(such is Hawala1 system of informal banks and payment institutions) as well as usage of crypto currencies.
Payment institutions and electronic money institutions shall be required to notify the National Bank of Serbia immediately of any changes in data entered in the registers referred to in this Section, and the National Bank of Serbia shall enter these changes within three days from receiving such notification.
The National Bank of Serbia shall supervise foreign currency transactions of banks,electronic money institutions headquartered in the Republic and payment institutions- in the procedures established by the law governing their operations.
Nine payment institutions and one electronic money institution(which, in addition to the provision of payment services, implements the activities relating to the distribution of electronic money through a wide network of distributors) continued to develop their network of agents.
The EU Directive on Security of Network and Information System makes the general framework, 129 establishing security obligations for key financial service providers,including payment institutions, stock exchanges and financial market infrastructure.
Payment institutions that provide the international money remittance service belong to the group of reporting entities with the highest number of submitted suspicious activity reports, whose quality is constantly improving, with a small number of submitted reports explicitly expressing suspicion of money laundering, a predicate crime, or financing of terrorism.
In the period January-June 2019 National Bank of Serbia Insurance undertakings accounted for 55.9%,banks for 43.9% and payment institutions for 0.1%. There were no complaints against other financial services providers.
Among other things,the Decision expanded the supervisory role of the NBS Centre for Information System Supervision to information system management in payment institutions, electronic money institutions and the public postal operator that is, their operations linked with the provision of payment services and/or issuance of electronic money.
The Law on Payment Services is harmonised with the four most important EU directives on payment services(directives governing payment services, finality of settlement in payment systems, e-money, right to a basic payment account and comparability of fees). This Law introduced competition to banks in the domain of payment services provision anda as a result today there are 13 payment institutions and two e-money institutions operating in the Serbian market, alongside thousands of their representatives.
TheLaw on Payment Services has provided legal framework for the establishment andbusiness of electronic money institutions and payment institutions, which is an important step towards modernisation of the national payment system, as it improves client safety, increases the efficiency of payment transactions and enables development of innovative forms of payment. .
Consumer complaints The number of complaints against financial institutions received between 1 January and 31 March 2019 equalled 469, down by 8.6% y-o-y. Insurance undertakings accounted for 57.1%,banks for 42.6% and payment institutions for 0.2%. There were no complaints against other financial services providers.
This Decision lays down the Chart of Accounts and the contents of accounts in the Chart of Accounts,contents and format of financial statement forms for companies licensed by the National Bank of Serbia to engage, as payment institutions and/or electronic money institutions, in the provision of payment services and/or electronic money issuing, and to conduct other affairs in accordance with the provisions of the Law on Payment Services(RS Official Gazette, No 139/2014).

As a rule, greater competition means higher quality services and more favourable prices. The Law also creates the legal basis for the establishment andoperation of electronic money institutions and payment institutions. All types of payment services, including cutting-edge services, have been allowed for and regulated for the first time.
On-site and off-site supervision of payment services provision In 2018, the NBS adopted(based on the Law on Payment Services and the Decision on Detailed Conditions andManner of Supervision of Payment Institutions, Electronic Money Institutions and Public Postal Operator) two decisions on on-site supervision for the purpose of verifying payment institutions' compliance with regulations.

Projection of the amount of capital requirements for the first year of operation of a payment institution shall be a projection of the amount of these requirements calculated using the method specified in Article 90 of the Law which uniformly applies to all payment institutions, in accordance with the National Bank of Serbia's decision regulating capital and capital adequacy of payment and electronic money institutions. .
