GENERAL PROVISIONS APPLICABLE TO CONTRACTS AND DESIGN CONTESTS.
The 1980 Rome Convention on the law applicable to contractual obligations harmonises the rules of conflict of laws applicable to contracts.
Rules applicable to contracts awarded by concessionaires which are not contracting authorities.
This Directive does not seek to establish rules of private international law determining the law applicable to contracts and other legal relations.
The law applicable to contracts of insurance referred to by this Directive and covering risks situated within the Member States is determined in accordance with the following provisions.

The Commission has stated its view on the requirements arising from the case-law of the Court in its Interpretative Communication on the Community law applicable to contract awards not or not fully subject to the provisions of the Public Procurement Directives49.
We are therefore not indifferent to the potential linked to the existence of a common body of general standards and principles applicable to contract law, in terms of increasing cross-border transactions, of regulating e-commerce and of improving consumers' access to products.
It should therefore be clarified that the transmission and/or distribution of heat is an activity covered by Annex II andthus entities which are active in the heating sector are subject to the rules of this Directive applicable to contracting entities in so far as they qualify as such.
Principles applicable to public contracts and scope.
These rules are less restrictive than similar provisions currently applicable to public contracts.
In particular, Article 5 of Directive 2004/113/EC remains applicable to the contracts of insurance and related financial services.
