Provisions amending the Defence Code.
الأحكام المعدلة لقانون الدفاعThe Defence Code is amended as follows.
The offences laid down in articles L2341-1 and L2341-4 of the Defence Code;
الجرائم المبيَّنة في المادتين L2341-1 و L2341-4 من قانون الدفاعIn domestic law, under the French Defence Code, arms exports are prohibited as a general rule.
وكقاعدة عامة يحظر The Defence Code, and in particular Ordinance No. 2004-1374 of 20 December 2004, establishes the rules for war materiel, arms and ammunition.
ويحدد قانون الدفاع، ولا سيما المرسوم رقم 2004-1374 المؤرخ 20 كانون الأول/ديسمبر 2004، نظام المعدات الحربية والأسلحة والذخائرThe provisions of the said Law have been incorporated into the Defence Code(articles L. 2342-1 to L. 2342-84).
وقد أدرجـت أحكام هذا The physical protection of facilities exhibiting a proliferation risk is governed in France byarticles L. 1332-1 to L. 1332-7 of the Defence Code.
الحماية المادية للمنشآت التي تنطوي على خطر يهدد بانتشارالأسلحة تنظمها في فرنسا المواد من L1332-1 إلى 7 من قانون الدفاعLaw No. 425 of 7 July 1959,adding new offences to the existing code(Social Defence Code), including offences that intrinsically constituted terrorist acts; it also increased penalties for other felonies also related to such acts.

القانون رقم 21 المؤرخ 15 شباط/فبراير 1979، الذي يتضمن القانونالجنائي الجديد الذي حل محل قانون الدفاع الاجتماعي السابق، الذي ألغيThe export from France of war materiel is strictly controlled on the basis of, inter alia,article L 2335-3 of the Defence Code(an instrument having the force of law) which provides that the unauthorized export, under any customs regime, of war materiel or related items is prohibited.
ويخضع تصدير الأعتدة الحربية من فرنسا لمراقبة صارمةبموجب المادة L 2335-3 من قانون الدفاع(وهو نص ذو قيمة تشريعية) التي تنص على" حظر تصدير الأعتدة الحربية أو المعدات المماثلة دون ترخيص، أيا كان النظام الجمركيMeasures taken in respect of persons on board are regulated by the first part, book V, titleII, sole chapter, section 3 of the Defence Code.
ويجري تنظيم التدابير التي تتخذ بشأن الأشخاص على متن السفن عن طريق المادة 3 الفصل الوحيد، في البابالثاني من الكتاب الخامس من الجزء الأول من قانون الدفاع(5) The Committee notes with appreciation thesignature of a memorandum by the Ministry of Defence to amend the Defence Code in order to ensure that all children under the age of 18 do not take part in hostilities, in accordance with article 1 of the Optional Protocol.
(5) تلاحظ اللجنة مع التقدير توقيعوزارة In addition, procedures for the import, export and transfer of war material, arms,ammunition and similar material are laid down by French Defence Code implementing provisions.

وقد أُدرجت الأحكام المنقحة لهذا Prohibition, unless authorized by the State and under its control: this principle, which is justified by the unique nature of the arms trade,is captured in legislation(articles L-2335-2 and 3 of the Defence Code);
مبدأ حظر التصدير ما لم يتم بإذن من الدولة وتحت رقابتها؛ وهو مبدأ تشريعي تبرره الطبيعة الخاصة لتجارةالأسلحة(المادتان L-2335-2 و L-2335-3 من قانون الدفاع)A draft law ratifying order No. 2012-6 dated 5 January 2012 modifying books I and V of the environment code, the public health code and the defence code[text No. 481(2011-2012)] was submitted to the French Senate on 21 March 2012.
وقُدم إلى مجلس الشيوخ الفرنسي، في 21 آذار/مارس 2012، مشروع قانون للتصديق على الأمر رقم 2012-6 المؤرخ 5 كانون الثاني/يناير 2012 الذي ينص على تعديل الكتابين الأول والخامس منمدونة البيئة، The law provides for criminal penalties in cases of failure to comply with the legislative and regulatory provisions concerning the export of war materiel andrelated items(articles L 2339-2 et seq. of the Defence Code).
وينص القانون على عقوبات جنائية في حال تجاهل الأحكام التشريعية والتنظيمية المتعلقة بصادرات المعدات الحربية والمعداتالمماثلة(المادة L.2335-2 وما يليها من قانون الدفاعIn addition, article 28 of the Act of 13 July 1983 relieves any civil servant of his or her obligation to carry out instructions of a superior official" in the event that the order given is manifestly unlawful and may seriously undermine a public interest";and article L. 4122-1 of the Defence Code provides that" military personnel must obey the orders of their superior officers and are responsible for executing the missions entrusted to them.
وتضاف إلى ما سبق أحكام المادة 28 من Lastly, as to the impossibility of invoking any order to justify a crime of enforced disappearance, reference is made to the provisions of article 122-4 of the Criminal Code, article 28 of the Act of 13 July 1983 on the rights and obligations of civil servants andarticle L. 4122-1 of the Defence Code, which are cited above, in the observations related to article 1 of the Convention.
