Processing of personal data collected during joint operations,pilot projects and rapid border interventions and by migration management support teams.

In writing.-(FR) Due to the fact that several Member States have been confronted with critical situations in the shape of massive influxes of illegal immigrants arriving by sea,the European Union has deemed it necessary to create Rapid Border Intervention Teams.
During the deployment of a joint operation, pilot project, rapid border intervention, return operation or return intervention, members of the teams shall be treated in the same way as officials of the host Member State with regard to any criminal offences that might be committed against them or by them.
Regulation(EC) No 863/2007 of the European Parliament and of the Council of 11 July2007 establishing a mechanism for the creation of Rapid Border Intervention Teams and amending Council Regulation(EC) No 2007/2004 as regards that mechanism and regulating the tasks and powers of guest officers.
Once the Council and the European Parliament adopted theCommission's proposal for a Regulation establishing Rapid Border Intervention Teams- that is expected to happen before the end of the German Presidency- the Agency shall take all the necessary measures aiming at proper implementation of the Regulation e.g. creation of a pool of border guards, advanced training.

Regarding the establishment of procedures for emergency situations, the Council has recently concluded consultations with the European Parliament on a proposal for a Regulation of the European Parliament andof the Council establishing a mechanism for the creation of Rapid Border Intervention Teams and amending the Council Regulation as regards that mechanism.
Any person who is directly affected by the actions of staff involved in a joint operation, pilot project, rapid border intervention, return operation or return intervention, and who considers him or herself to have been the subject of a breach of his or her fundamental rights due to those actions, or any third parties intervening on behalf of such a person, may submit a complaint, in writing, to the Agency.
The objectives of a joint operation or rapid border intervention may be achieved as part of a multipurpose operation which may involve the rescue of persons in distress at sea or other coast guard functions, the fight against migrant smuggling or trafficking in human beings, drug trafficking control operations, and migration management including identification, registration, debriefing and return.
This proposal amends Council Regulation(EC) No 2007/2004 establishing the Frontex Agency, which has been amended in 2007 by Regulation(EC) No 863/2007 of the European Parliamentand of the Council establishing a mechanism for the creation of Rapid Border Intervention Teams, which were based on the equivalent provisions of the Treaty establishing the European Community, that is, Articles 62(2)(a) and 66.
I would like to emphasise our complete disagreement with the points of the resolution backing the current immigration policy, in particular with regard to immigration from North Africa,in that it supports the creation of'Rapid Border Intervention Teams' and of a'European coastguard body' within the framework of the European Agency for the Management of Operational Cooperation at the External Borders(FRONTEX), with the aim of alleviating'the immediate pressure to deal with this problem.
