On 19 June 1990 the Convention Implementing the Schengen Agreement was signed.
The reinstatement of border controls is a measure which is explicitly laid down in Article 2 item 2 of the Convention implementing the Schengen Agreement.
Articles 9 to 17 of the Convention implementing the Schengen Agreement of 14 June 1985 shall be repealed.

No one should be under any illusions- the Convention implementing the Schengen Agreement is not the law of the European Union; it is not Community law, but an intergovernmental instrument.
This is without prejudice to their right to apply and be admitted to reside in other Member States pursuant to relevant provisions of Union and national law andtheir right to move freely in accordance with the conditions of Article 21 of the Convention Implementing the Schengen Agreement.
According to Article 21 of the Convention Implementing the Schengen Agreement of 14 June 1985 on the gradual abolition of checks at the common borders, all Schengen States must recognise the long-stay visas and residence permits issued by each other as valid for short stays on each other's territories.
The key milestone in establishing an internal market with free movement of persons was the conclusion of the two Schengen agreements,i.e. the Agreement proper of 14 June 1985, and the Convention implementing the Schengen Agreement, which was signed on 19 June 1990 and entered into force on 26 March 1995.
Under current Community law, namely,Article 18 of the Convention implementing the Schengen Agreement, third-country nationals are only permitted to transit through the territory of other Member States in order to reach the country which issued the long-stay visa.
The provisions of this Regulation shall not affect the special rules applying to the cities of Ceuta and Melilla, as defined in the Declaration by the Kingdom of Spain on the cities of Ceuta andMelilla in the Final Act to the Agreement on the Accession of the Kingdom of Spain to the Convention implementing the Schengen Agreement of 14 June 1985(31).
In accordance with Article 26 of the Convention Implementing the Schengen Agreement carriers shall consult the ETIAS Central System in order to verify whether or not third country nationals subject to the travel authorisation requirement are in possession of a valid travel authorisation.
(ii) where an air carrier does not check that circumstance or does not refuse to transport a traveller who is unable to provide evidence that he is a family member- and who, moreover,holds a permanent residence card- is it possible to impose a fine on that carrier on that ground pursuant to Article 26(2) of the Convention implementing the Schengen Agreement?
The aim of this Directive is to supplement the provisions of Article 26 of the Convention implementing the Schengen Agreement of 14 June 1985, signed at Schengen on 19 June 1990(5)(hereinafter referred to as"the Schengen Convention") and to define certain conditions with respect to their implementation.

France considers that the implementation of the Protocol integrating the Schengen acquis into the framework of the European Union does not affect the geographical scope of the Convention implementing the Schengen Agreement of 14 June 1985 signed in Schengen on 19 June 1990, as it is defined by Article 138, first paragraph, of that Convention. .
Amending the Convention implementing the Schengen Agreement of 14 June 1985 on the gradual abolition of checks at common borders as regards access to the Schengen Information System by the services in the Member States responsible for issuing registration certificates for vehicles.

Comparison with the information systems established,for example, under the Convention implementing the Schengen Agreement, the Europol Convention and the Eurojust Decision, which provide for a period of storage of one to three years, demonstrates the excessive length of the period mentioned in the undertakings;
By way of derogation from paragraph 5 of this Article, where, for the same third-country national,the carriers referred to in paragraph 1 of this Article are already subject to the penalties provided for in accordance with Article 26(2) of the Convention Implementing the Schengen Agreement and Article 4 of Directive 2001/51/EC, the penalties referred to in paragraph 5 of this Article shall not apply.
Article 21 of the Convention implementing the Schengen Agreement provides a right to free movement within the territory of the states party to the Agreement for a period of not more than 90 days in any 180 days, by instituting the mutual recognition of the residence permits and long stay visas issued by these States.
European Parliament legislative resolution on the proposal for a Council regulation laying down the requirement for the competent authorities of the Member States to stamp systematically the travel documents of third-country nationals when they cross the external borders of the Member States and amending the convention implementing the Schengen agreement and the common manual to this end(COM(2003) 664- C5-0580/2003- 2003/0258(CNS)) 628.
The obligations provided for in this Directive are complementary to those laid down by Article 26 of the Convention implementing the Schengen Agreement, as supplemented by Council Directive 2001/51/EC, concerning the obligation of carriers to return third-country nationals who are refused entry by the Member State of destination.
