(1) Article 5(1) of Commission Regulation(EC) No 94/2002(2), as last amended by Regulation(EC) No 1186/2002(3), lays down, for the purposes of implementing measures contained in programmes as referred to in Article 6 of Regulation(EC) No 2826/2000, the deadline of 15June each year for Community trade federations or interbranch organisations to submit programmes to the Member State concerned.
Member States may recognise as interbranch organisations, within the meaning of this Regulation, all legal persons established on their territory which make an appropriate application and which are made up of representatives of activities linked to the production of and/or trade in and/or processing of the products referred to in Article 1, on condition that.
The first sentence of Article 5(1) is replaced by the following:"With a view to implementing measures contained in programmes as referred to in Article 6 of Regulation(EC) No 2826/2000,the Community trade federations or interbranch organisations that are representative of the sector(s) concerned shall submit programmes in response to calls for proposals issued by the Member States concerned no later than 31 January and 31 July each year.";
Where an interbranch organisation operating in a specific region or regions of a Member State is considered to be representative of the production of and/or trade in and/or processing of a given product, the Member State concerned may, at the request of the organisation, make some of the agreements, decisions or concerted practices agreed on within that organisation binding for a limited period on other operators in the region or regions in question, whether individuals or groups, who do not belong to the organisation.
With a view to implementing measures contained in programmes as referred to in Article 6 of Regulation(EC) No 2826/2000,the Community trade federations or interbranch organisations that are representative of the sector(s) concerned shall submit programmes in response to calls for proposals issued by the Member States concerned no later than 15 March the first time and no later than 15 June thereafter.
(149) Certain rules in the milk and milk products sector, in particular contractual relations and negotiations, regulation of supply of cheese with a protected designation of origin or protected geographical indication, declarations by first purchasers, producer organisations,associations of producer organisations and interbranch organisations have recently entered into force and remain justified in the current economic circumstances of the dairy market and the structure of the supply chain.
(31) In order to ensure▌the efficient and effective use of the Union aid provided for producer organisations,associations of producer organisations or interbranch organisations in the olive oil and table olive sector to improve the production quality of olive oil and table olives▌, the power to adopt certain acts▌should be delegated to the Commission in respect of the specific measures that can be financed by the Union aid and the activities and costs that cannot;
The first sentence of Article 5(1) of Regulation(EC) No 94/2002 is hereby replaced by the following:"With a view to implementing measures contained in programmes as referred to in Article 6 of Regulation(EC) No 2826/2000,the Community trade federations or interbranch organisations that are representative of the sector(s) concerned shall submit programmes in response to calls for proposals issued by the Member States concerned before 31 March the first time and before 15 June thereafter.".
