I voted for the proposal on ship-source pollution as I believe it is essential to tackle this continued practice in sea transport, namely illegal discharges of polluting substances into the sea by certain ships.
All this is derived from the need to address widespread problems in maritime transport,such as the worrying escalation of illicit operational discharges of ship-source polluting substances.
Therefore, in full compliance with Community case law,the proposal on ship-source pollution calls upon Member States to provide for and introduce penalties in their criminal legislation for a limited number of serious cases which the proposal identifies.
Despite the expiry of the Community framework for cooperation,the Commission intends to continue and promote its actions in the field of the fight against ship-source pollution from 2007 onwards.
It is clear that serious ship-source pollution must be classified and punished as a criminal offence and minor ship-source pollution can be regarded a regulatory offence, so that there is a distinction between the seriousness of the two types of activity.
(3) Criminal penalties, which demonstrate social disapproval of a different nature than administrative sanctions,strengthen compliance with the legislation against ship-source pollution in force.
Only then can we envisage the widespread problem of the increase in the incidence andscale of illegal operational discharges of ship-source polluting substances being brought under control, and only then will our task of fighting to keep our seas clean have real hope of success.
