Chapter 5 NOTIFICATION 5.1 When a marine casualty occurs on the high seas or in an exclusive economic zone, the flag State of a ship, orships, involved, shall notify other substantially interested States as soon as is reasonably practicable.
That State shall remain responsible for the investigation andcoordination with other substantially interested Member States until such time as it is mutually agreed which of them is to be the lead investigating State.
When a marine casualty occurs within the territory, including the territorial sea, of a coastal State, the flag State, and the coastal State,shall notify each other and between them notify other substantially interested States as soon as is reasonably practicable.
This State shall remain responsible for the investigation andcoordination with other substantially interested States until such time as it is mutually agreed which is to be the lead investigating State.
When the flag State(s), a coastal State(if involved)or other substantially interested States are seeking to reach agreement, in accordance with chapter 7 of Part II on which State or State(s) will be the marine safety investigating State(s) under this Code, the following factors should be taken into account.
Lead investigating Member State' means a Member State that isrequired to conduct or, where there is more than one substantially interested State, to lead, a safety investigation in accordance with this Directive.
Will agree in advance that host States and any substantially interested Member State may conduct, participate fully in or cooperate with any investigation of a marine casualty or incident in accordance with Article 12, and will give them access to the information retrieved from the VDR of their ferry or craft involved in such a casualty or incident.
For a marine casualty referred to in paragraphs 7.1 or 7.2,agreement may be reached by the relevant States with another substantially interested State for that State or States to be the marine safety investigating States.

The scope and the practical arrangements for the conduct of safety investigations shall be determined by the investigative body of the lead investigating Member State in cooperation with the equivalent bodies of the other substantially interested States, in such manner as appears to it most conducive to achieving the objectives of this Directive, and with a view to preventing future casualties and incidents.
Member States shall define, in the framework of their respective internal legal systems,a legal status that will enable them and any other substantially interested Member State to participate, to cooperate in, or where provided for under the Code for the investigation of marine casualties, to conduct any marine casualty or incident investigation involving a ro-ro ferry or high-speed passenger craft.
