Madeira(within a local production limit of 4 000 tonnes of milk) andthe French overseas departments are exempt from the additional levy scheme applicable to producers of cow's milk laid down by Regulation(EC) No 1788/2003.
The reference quantity exempt from the additional levy was equal to the quantity of milk or milk equivalent, either delivered by a producer or purchased by a dairy, as decided by the Member State, during the reference year, which in the case of the Kingdom of the Netherlands was 1983.

Having regard to Council Regulation(EEC) No 3950/92 of 28 December 1992 establishing an additional levy in the milk and milk products sector(1), as last amended by Regulation(EC) No 1256/1999(2), and in particular Articles 3(2) and 4(2) thereof.
Those detailed rules should also incorporate, to a great extent, provisions of Commission Regulation(EC) No 1392/2001 of 9 July 2001 laying down detailed rulesfor applying Council Regulation(EEC) No 3950/92 establishing an additional levy on milk and milk products(2).

Pursuant to that Article,that number is equivalent to the number of dairy cows needed to produce the individual milk reference quantity allocated to the producer on 31 March preceding the beginning of the 12-month period of application of the additional levy scheme beginning in the calendar year concerned.
Having regard to Council Regulation(EEC) No 3950/92 of 28 December 1992 establishing an additional levy in the milk and milk products sector(1), as last amended by the Act of Accession of Austria, Finland and Sweden, and in particular the seventh subparagraph of Article 3(2) thereof.
(1) Article 23 of Council Regulation(EC) No 1453/2001(2) introduced for a period of four marketing years beginning in 1999/2000 a derogation from certain provisions of Regulation(EEC)No 3950/92 of 28 December 1992 establishing an additional levy in the milk and milk products sector(3) as regards the Azores.
(b) is less than the proceeds of the production levies and, if applicable, the additional levy, the difference shall be deducted from the estimate of overall loss or added to the estimate of overall revenue, as the case may be, resulting from applying Articles 15 and 16 to the marketing year concerned.
