All passengers departing from an airport located in the territory of a Member State are covered.
This Directive applies to any airport located in the territory of a Member State, subject to the provisions of the Treaty, and open to commercial traffic in the following circumstances.
Under Article 3(1)(a) of Regulation No 261/2004, that regulation is applicable to, in particular,passengers departing from an airport located in the territory of a Member State to which the Treaty applies.

Without prejudice to paragraph 1, the provisions of this Directive shall apply as from 1 January 2001 to any airport located in the territory of a Member State, subject to the provisions of the Treaty, and open to commercial traffic, whose annual traffic is not less than 2 million passenger movements or 50 000 tonnes of freight.
Rather, the plain meaning of the text is that it covers all outbound flights leaving‘an airport located in the territory of a Member State to which the Treaty applies'(Article 3(1)(a)) but covers inbound flights only where they are operated by a Community carrier(Article 3(1)(b)).
It follows from Article 3(1) as a whole that the regulation applies to situations in which passengers use a flight either departing from an airport located in the territory of a Member State(indent(a)) or departing from an airport located in a nonmember country and flying to an airport located in the territory of a Member State if the air carrier operating the flight concerned is a Community carrier(indent(b)).
