Whereas it is equally appropriate to align the test conditions of Directive 70/220/EEC with those of Council Directive 80/1268/EEC of 16 December 1980 on the approximation of the laws of the Member States relating to the emissions of carbon dioxide and the fuel consumption of motor vehicles(5), as last amended by Commission Directive 93/116/EC(6),in particular as far as the relationship between the reference mass of the vehicle and the equivalent inertia which is to be used.
The pendulum block shall be pulled back so that the height of its centre of gravity above that at the point of impact is given by one of the following two formulae,to be chosen according to the reference mass of the assembly subjected to the tests.
After publication of the delegated acts adopted in accordance with the second subparagraph and at the manufacturer's request, this Regulation shall apply to vehicles of categories M1, M2, N1 andN2 as defined in Annex II to Directive 2007/46/EC of the European Parliament and of the Council* with a reference mass exceeding 2 610 kg but with a maximum vehicle mass not exceeding 5 000 kg.
The Commission shall be empowered to adopt delegated acts in accordance with Article 14a concerning the detailed rules on the application of this Regulation to vehicles of categories M1,M2, N1 and N2 as defined in Annex II to Directive 2007/46/EC with a reference mass exceeding 2 610 kg but with a maximum vehicle mass not exceeding 5 000 kg.
