The Regulation applies to vehicles of categories M1, M2, N1 and N2,as defined in Annex II of Directive 2007/46/EC, with a reference mass exceeding 2 610 kg and all motor vehicles of categories M3 and N3, as defined in that Annex.
The Commission shall be empowered to adopt delegated acts in accordance with Article 14a concerning the detailed rules on the application of this Regulation to vehicles of categories M1, M2,N1 and N2 as defined in Annex II to Directive 2007/46/EC with a reference mass exceeding 2 610 kg but with a maximum vehicle mass not exceeding 5 000 kg.
Article 11 of Regulation(EC)No 661/2009 requires all vehicles of M1 category with a reference mass not exceeding 2 610 kg and vehicles to which type-approval is extended in accordance with Regulation(EC) 715/2007 to be equipped with gear shift indicators.
After publication of the delegated acts adopted in accordance with the second subparagraph and at the manufacturer's request, this Regulation shall apply to vehicles of categories M1, M2, N1 and N2 as defined in Annex II to Directive 2007/46/EC of the European Parliament andof the Council* with a reference mass exceeding 2 610 kg but with a maximum vehicle mass not exceeding 5 000 kg.
Confirm the inclusion in this Regulation of vehicles in category N2 andM2 as defined in Annex II to Directive 2007/46/EC with a reference mass not exceeding 2 610 kg and to vehicles to which type-approval is extended in accordance with Article 2(2) of Regulation(EC) No 715/2007.
The EESC endorses the Commission's proposal not to apply the new Regulation, if a manufacturer so requests, to vehicles of categories M1, M2,N1 and N2 with a reference mass not exceeding 2 840 kg that are type-approved under Regulation(EC) No 715/2007.
This Regulation shall apply to motor vehicles of category M1 asdefined in Annex II to Directive 2007/46/EC with a reference mass not exceeding 2 610 kg and vehicles to which type-approval is extended in accordance with Article 2(2) of Regulation(EC) No 715/2007('passenger cars') which are registered in the Community for the first time and which have not previously been registered outside the Community('new passenger cars').
At the manufacturer's request this Regulation may also apply to motor vehicles equipped with compression ignition engines of categories M2 and N2, as defined in[Annex II] of Directive[XXXX/XX/EC],having a reference mass not exceeding 2 840 kg and which meet the conditions laid down in this Regulation and its implementing measures.
(4) The Commission will study further the question of extending the type-approval test to vehicles in Categories M2 andN2 with a reference mass not exceeding 2 840 kg and put forward proposals no later than 2004 in accordance with the procedure laid down in Article 13 of Directive 70/156/EEC, for measures to be applied in 2005.'.
In order to receive an extension of the EU type-approval of avehicle with regard to emissions type-approved under this Regulation with a reference mass exceeding 2 380 kg but not exceeding 2 610 kg, the manufacturer shall meet the requirements set out in Section 5 of Annex VIII.';
In order to receive an extension of the EC type-approval of a vehicle with regard to emissions and vehicle repair andmaintenance information type-approved under this Regulation with a reference mass exceeding 2 380 kg but not exceeding 2 610 kg, the manufacturer shall meet the requirements set out in Section 5 of Annex VIII.
Member States shall also collect and report data, in accordance with this Article, on registrations of vehicles in categories M2 andN2 as defined in Annex II to Directive 2007/46/EC with a reference mass not exceeding 2 610 kg and to vehicles to which type-approval is extended in accordance with Article 2(2) of Regulation(EC) No 715/2007.
