The Working Party noted that the underlying situation was a specific case of a more general issue, namely how many TIR Carnets are required if heavy orbulky goods are transported together with normal goods.
The comment to Article 17 only provides foran exception to this rule in case a consignment consisting of both normal goods and heavy or bulky goods is transported in a combination of vehicles.
Therefore, if the Customs office of departure wished to accept a single TIR Carnet for such a mixed cargo, this TIR Carnet would have to bear the endorsement"heavy or bulky goods" and, on the other hand,should not bear that inscription for normal goods.
The earlier adopted comment specifically addresses the situation when vehicles considered as heavy orbulky goods are carrying normal goods to be transported under Customs seals in the load compartment or in containers.
It became clear, however, that the situation addressed by the above comment is a specific case of a more general issue, namely how many TIR Carnets are required if heavy orbulky goods are transported together with normal goods.
The objective of Article 32 is to provide a clear distinction between normal goods to be transported under Customs seal and heavy or bulky ones which may be carried by means of non-sealed vehicles or containers in line with Article 29.
In particular, the Working Party addressed the situation where road vehicles, or special vehicles, regarded themselves as heavy or bulky goods, are carrying normal goods in the sealed load compartment or in containers.
Since this endorsement does not apply to normal goods transported under Customs seal, a separate TIR Carnet(or TIR Carnets) shall be required to cover the transport of normal goods.{TRANS/WP.30/AC.2/71, Annex 3; TRANS/WP.30/206, paragraph 57.
As the treated case in the comment in Annex 6 to document TRANS/WP.30/AC.2/59 is formulated concerning one vehicle that has a Certificate of Approval and bears Customs seals(it is not subject to the special conditions set forth in Chapter III(c)of the Convention), the vehicle itself is treated in accordance with the Convention as normal goods.

As a consequence, the two last sentences of the above comment in Annex 6 to document TRANS/WP.30/AC.2/59 concerning one vehicle transporting normal goods, are in legal contradiction with Article 17 of the Convention as well as with the obligatory rules in Annex 1 to the Convention similarly as Article 12 of the Convention and the regulations in Annex 2 to the Convention are obligatory.
As it is correctly stated,the objective is to provide a clear distinction between normal goods to be transported under Customs seal and heavy or bulky goods, which may be transported by means of a non-sealed vehicle or container in accordance with Article 29 of the Convention.
From the point of view of the organization issues, delivery of the consolidated cargoes is a much more complicated process than delivery of normal goods, because of the need to comply with a strict cargo clearance procedures, to build the best transportation route as well as to take into account the peculiarities of customs clearance in each of the countries crossed by the vehicle upon delivery.
When taking a decision on the number of TIR Carnets required for the transport of a mixed cargo consisting of both normal goods and heavy or bulky goods, the Customs office of departure shall take into account the specific provisions of Article 32 according to which for the transport of heavy or bulky goods the cover and all vouchers of the TIR Carnet shall bear the endorsement"heavy or bulky goods. .
