Article 17Addressing or removing impediments to resolvability.
Where substantive impediments to resolvability are identified then Article 27(1) applies.

The Board should assess the resolvability of institutions and groups,and take measures aimed at removing impediments to resolvability, if any.

The joint decision referred to in points(b) and(c) of paragraph 1 shall be adopted within four months ofsubmission of the CCP's proposed measures to remove impediments to resolvability.

When drawing up and updating the resolutionplan, the Board shall identify any material impediments to resolvability and, where necessary and proportionate, outline relevant actions for how those impediments could be addressed, in accordance with Article 10.
In identifying alternative measures, the Board shall demonstrate how the measures proposed by the institutionwould not be able to remove the impediments to resolvability and how the alternative measures proposed are proportionate in removing them.
When drawing up the resolution plan,the resolution authority shall identify any material impediments to resolvability and, where necessary and proportionate, outline relevant actions for how those impediments could be addressed, according to Chapter II of this Title.

The Board should require the national resolution authorities to apply such appropriate measures designed to remove impediments to resolvability in order to ensure consistency and the resolvability of the institutions concerned.
The resolution authority shalltake into account the threat to financial stability of those impediments to resolvability and the effect of the measures on the business of the institution, its stability and its ability to contribute to the economy.
In its assessment the Financial Supervision Authority shalltake into account the threat to financial stability of those impediments to resolvability and the effect of the measures on the business of the credit institution, its stability and its ability to contribute to the economy.
