For Croatia, Phare will be implemented under decentralised implementation system(DIS).
Turkey moved to a DIS(decentralised implementation system) in October 2003, with the indicative target to proceed with EDIS in 2007.
Concerning the Western Balkans, only Croatia operates under the Decentralised Implementation System(DIS).

In Bulgaria and Romania, for Phare and ISPA,this process was governed in 2004 by the Decentralised Implementation System(DIS).
DID THE EUROPEAN COMMISSION ENSURE THAT THE DECENTRALISED IMPLEMENTATION SYSTEM RESULTED IN TIMELY AND SUCCESSFUL ACHIEVEMENT OF PROJECT OUTPUTS AND OBJECTIVES?
EDIS stands for the processenvisaged for the beneficiary countries to move towards an“extended decentralised implementation system” for ISPA.
The requirement for the DIS(Decentralised Implementation System) accreditation of the implementing agency in Croatia, the CFCA, follows the provision of Article 164 of the Financial Regulation4.
Turkey has beenimplementing EC financial assistance since 2003 under the decentralised implementation system(accredited in October 2003).
DECENTRALISED IMPLEMENTATION SYSTEM DIS THE DIS DID NOT ACHIEVE TIMELYIMPLEMENTATION OF THE PROJECTS AUDITED BUT REMEDIAL ACTION HAS SINCE BEEN TAKEN THEINTENDED OUTPUTS OF AUDITED PROJECTS WERE EVENTUALLY DELIVERED AND THE RESULTS ASSESSED AS LIKELY TO BE SUSTAINED.
By the date of accession, an extended decentralised implementation system(EDIS) was in place.
However, an advisory audit was carried out by DG Regional Policy's Control and Audit Unit on the National Fund and Implementing Agency(CFCU)in April 2007 as a follow-up to the previous ISPA DIS(Decentralised Implementation System) accreditation mission.
In view of the time necessary to set up the fully decentralised implementation system and based on related SAPARD12 experience, the financial allocations for Component V follow a phasing-in approach with a back loading of IPA Rural Development funds.
Projects including 212 for the environment, 102 for transport and 10 for the related extended decentralised implementation system(EDIS).
Until EDIS(Extended Decentralised Implementation System- requiring ex-post control only) is granted, the staff of the EC Delegation in Croatia will continue to carry out ex-ante controls and play an important role in supervising the daily management, implementation and monitoring of ISPA measures.
The Commission decision on partial conferral of management for Phare andCARDS under the decentralised implementation system(DIS) to Croatia was taken on 7 February 2006.
The Commission has expressed some concerns over the capacity of Romanian agencies to ensure a sound management of EU funds and decided to ask the responsible authorities to address the remaining shortcomings and to provide proof that progress has been reached in ensuring that pre-accessionprogrammes are implemented under a sound extended decentralised implementation system.
To answer audit question(b), reported in part 2 of the observations, we reviewed the proceduresfollowed to assess the country's readiness to manage a decentralised implementation system for IPA assistance and examined how the Commission used experience of this management mode to strengthen administrative capacity in the country.
VI While acknowledging that the Decentralised Implementation System(DIS) could slow down the process of establishing needs and delivery of results, the Commission would like to point out that the process of programming the financial assistance and implementing these programmes and measuring results is a sequenced and complex exercise which takes several years in general regardless the type of projects or management mode.
With regard to Phare and post-accession Transition Facility assistance,Bulgaria has operated under an Extended Decentralised Implementation System(EDIS) since July 2007.
Concerning Bulgaria and Romania, Phare assistance is currently still implemented in a partially decentralised way,through the partially decentralised implementation system("DIS"), where the national authorities as contracting authorities are responsible for all implementation and paying functions, while the EC Delegation maintains the systematic ex-ante control requirement by over each tendering and contracting.
The Court's audit examined a sample ofcompleted projects, the system for programming new projects, and the functioning of the decentralised implementation system(see paragraphs 9to 10).
The ex-ante control by the Commission over tendering and contracting shall be waived by a Commission decision to that effect,following a positively assessed Extended Decentralised Implementation System( EDIS) in accordance with the criteria and conditions laid down in the Annex to Council Regulation( EC) No 1266/1999 on coordinating aid to the applicant countries in the framework of the pre-accession strategy and amending Regulation( EEC) No 3906/89( 4).
As regards implementation of financial assistance under IPA I,de-commitments of funds and the future risks of loss of funds from programmes under the Decentralised Implementation System(DIS) have remained a source of concern.

The most notable project in the field of transport was the multimodal rail and road bridge across the Danube. The report notes that between 2000 and 2004 ISPA cofinanced 72 projects in these two countries, including 53 for the environment and 17 for transport, plusa technical assistance measure in each country to ensure decentralised implementation(‘extended decentralised implementation system,'EDIS). EDIS.
The Commission shall adopt European decisions to waive the ex-ante control by the Commission over tendering andcontracting following a positively assessed Extended Decentralised Implementation System(EDIS) in accordance with the criteria and conditions laid down in the Annex to Council Regulation(EC) No 1266/1999 of 21 June 1999 on coordinating aid to the applicant countries in the framework of the pre-accession strategy and amending Regulation(EEC) No 3906/89.
The preparations for the move to EDIS willbe dependent on an improvement in the functioning of the current Decentralised management Implementation System(DIS) structure with ex-ante controls by the EC Delegation.
The Commission rightly points the finger at delays in the launch of programmes,the complexities inherent in the system and decentralised implementation, which has not yielded positive results.
Until the management of ISPA funds is fullydecentralised(using the Extended Decentralised management Implementation System- EDIS with only ex-post control by the Commission), the staff of the EC Delegation in Croatia will continue to play an important role in supervising the daily management, implementation and monitoring of ISPA measures.
