Reference provisions for Community legislation laying down the conditions for the marketing of products.
The Decision provides common principles and reference provisions for the purposes of legislation based on the New Approach principles.
Regulation(EC) No 2003/2003 should therefore be replaced by this Regulation,drafted to the extent possible in accordance with those common principles and reference provisions.
This Decision includes reference provisions concerning procedures dealing with products presenting a risk in order to ensure the safety of the market place.
The proposal for a Decision on a common framework for the marketing of productsis intended to provide common principles and reference provisions for the revision of sectoral legislation.
Unlike Decision 768/2008/EC which only contains reference provisions, the horizontal“umbrella” regulation would also be legally binding and directly applicable.

(3) This Decision provides, in the form of reference provisions, definitions and general obligations for economic operators and a range of conformity assessment procedures from which the legislator can select as appropriate.
(6) Decision No 768/2008/EC of the European Parliament and of the Council of 9 July 2008 on a common framework for themarketing of products18 provides common principles and reference provisions for the purposes of legislation based on the New Approach principles.
(2) This Decision provides common principles and reference provisions intended to apply across sectoral legislation in order to provide a coherent basis for revision or recasts of that legislation.
That Decision has been repealed by Decision No 768/2008/EC of the European Parliament and of the Council of 9 July 2008 on a common framework for the marketing of products(12),and lays down common principles and reference provisions intended to apply across sectoral legislation in order to provide a coherent basis for drawing up, revision or recasts of that legislation.
It is therefore necessary to incorporate the definitions and reference provisions of Decision No 768/2008/EC into this Directive by making the adaptations which are required by the specific features of the marine equipment sector.

(3) Decision No 768/2008/EC of the European Parliament and of the Council( 6)lays down common principles and reference provisions intended to apply across sectoral legislation in order to provide a coherent basis for revision or recasts of that legislation.
The lack of urgency in ordering suspension of operation of Articles 5 and6 therefore necessarily entails dismissal of the application for suspension of operation of that reference provision.
Reference to the provisions of the Term of Protection Directive is therefore expressly envisaged.
The extent of that release shall be defined with reference to the provisions to which it applies.
Amendment 60 is acceptable as the reference to the provisions of Directive 96/676/EEC(Nitrates Directive) is sufficient.
