In applying this Agreement, the Parties are aware of the necessity of an adequate protection of individuals with regard to the processing of personal data and on the free movement of such data.

Provisions for the protection of personal data that particularise and complement those of Directive 95/46/EC of 24October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data(article 11).

Any processing of personal data undertaken in the implementation of this Directive must be in compliance with Directive 95/46/EC of the European Parliament and of the Council of 24October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data18.
(21) Directive 95/46/EC of the European Parliament and of the Council of 24October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such date22 applies to the processing of personal data within the framework of this Regulation.
Any exchange or transmission of information between competent authorities, other authorities, bodies or persons should be in accordance with the rules on transfer of personal data as laid down in Directive 95/46/EC of the European Parliament and of the Council of 24October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data11.
(1) Directive 95/46/EC of the European Parliament and of the Council of 24October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data(4) requires Member States to ensure the rights and freedoms of natural persons with regard to the processing of personal data, and in particular their right to privacy, in order to ensure the free flow of personal data in the Community.
(11) Directive 95/46/EC of the European Parliament and of the Council of 24October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data9 applies to the processing of personal data by the services in the Member States responsible for issuing registration certificates for vehicles.
With effect from 25 May 2018, Directive 95/46 was repealed and replaced by Regulation(EU) 2016/679 of the European Parliament and of the Council of 27 April2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data,and repealing Directive 95/46/EC OJ 2016 L 119, p.
(3) Directive 95/46/EC of the European Parliament and of the Council of 24October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data[43] seeks to harmonise the protection of fundamental rights and freedoms of natural persons in respect of processing activities and to guarantee the free flow of personal data between Member States.
Having regard to the provisions of Article 13 of the Regulation(EU) 2016/679 of the European Parliament and of the Council of 27 April2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC(hereinafter referred to as“GDPR”) we inform you of the following.
(13) Directive 95/46 of the European Parliament and of the Council of 24October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data24 govern the processing of personal data carried our in the Member States in the context of this Regulation and under the supervision of the Member States competent authorities, in particular the public independent authorities designated by the Member States.
Article 8 of Directive 95/46/EC of the European Parliament and of the Council of 24October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data13 prohibits in principle the processing of data concerning health.
For"Directive 2002/58/EC concerning the processing of personal data" in Recital 9, read"Directive 95/46/EC of the European Parliament and of the Council of 24October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data(4) and Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data".
Directive 95/46/EC of the European Parliament and of the Council of 24October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data16 governs the processing of personal data carried out in the Member States in the context of this Regulation and under the supervision of the competent authorities.

Since the Regulation 2016/679 of the European Parliament and of the EU Council, dated27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data,and repealing Directive 95/46/EC(General Data Protection Regulation) came into force, we adjusted our mechanisms of information protection and security to the requirements of the Regulation.
