The item entitled"Consideration of prevention of transboundary harm from hazardous activities and allocation of loss in the case of such harm" was included in the provisional agenda of the sixty-eighth session of the General Assembly pursuant to Assembly resolution 65/28 of 6 December 2010.
New Zealand welcomed the adoption by the General Assembly of resolutions 61/36 and 62/68 on the prevention of transboundary harm from hazardous activities andallocation of loss in the case of such harm.
Ms. Zabolotskaya(Russian Federation), having commended the articles on prevention of transboundary harm from hazardous activities andthe principles on the allocation of loss in the case of such harm, said that, with regard to the area covered by the principles, the diversity of opinion among States was largely due to the"sectoral" practice of treaty regulation of liability issues in that area.
Taking into account the views and comments expressed in the Sixth Committee at the sixty-second session of the General Assembly on the prevention of transboundary harm from hazardous activities andallocation of loss in the case of such harm.
III. Considerations with regard to a global convention on the prevention of transboundary harm from hazardous activities andallocation of loss in the case of such harm by the United Nations International Law Commission and the General Assembly.
The Netherlands stated that it was not aware of any instance in which it had pleaded or relied upon either the articles on the prevention of transboundary harm from hazardous activities orthe principles on the allocation of loss in the case of such harm.
The deliberations of the International Law Commission and the General Assembly on the topics of prevention of transboundary harm from hazardous activities and allocation of loss in the case of such harm and the(meagre) prospects for the start of negotiations on a global convention on those topics.
The Working Group requested clarification from the secretariat regarding the status of the possible start of negotiations on a global convention on the prevention of transboundary harm from hazardous activities andallocation of loss in the case of such harm.
