Adoption of the Deceased Estates Act, in 2011;
All deceased estates regardless of race now fall under the authority of the Master of the High Court.
This programme was well received not only by communities butalso by those involved in the administration of deceased estates.
Enactment of Deceased Estates(Wills, Inheritance and Protection Act in 2011);
The Bill will contribute to gender equality, allowing more women andchildren to share directly in the proceeds of deceased estates.
The passing of the Deceased Estates(Wills, Inheritance and Protection) Act in 2011 entrenches the protection offered to women and the immediate family more than it was under the Wills and Inheritance Act.
Government also undertook the review of the Wills and Inheritance Act andrecommended the adoption of a proposed Deceased Estates(Wills, Inheritance and Protection) Bill.
Furthermore and more importantly,the act provides that all the deceased estates, testate or intestate, will be governed by the Administration of Estates Act, No. 66 of 1965;
The Wills and Inheritance Act was reviewed afresh by the special Law Commission on Gender-Related Laws and has come up with a new inheritance scheme, divorced from the customary onethat previously prevailed and has concentrated on immediate family as beneficiaries of deceased estates. .
Make every effort to ensure that the Deceased Estates Bill and the Marriage, Divorce and Family Relations Bills, particularly in relation to the rights of women, enter into force as soon as possible(Ireland);
The decision requires that the Department of Justice design andimplement a system for the supervision of the administration of deceased estates that complies with the spirit of the Constitution.
In relation to the administration of estates, the court ordered that in future deceased estates which would have previously been administered by magistrates in terms of the Black Administration Act, 1927(Act 38 of 1927) must now be administered by the Master of the Supreme Court in terms of the Administration of Estates Act, 1965 Act 66 of 1965.

The Committee furthermore expressed concern that statutory and customary laws which discriminate against women remain in force, and urged Malawi to ensure that discriminatory laws are amended or repealed, and that measures are taken to expedite the enactment of outstanding bills in this regard,in particular the Gender Equality Bill, the Deceased Estates(Wills, Inheritance and Protection) Bill, and the Marriage, Divorce and Family Relations Bill.
The Board recommends that the Fund secretariat:(a) implement improved controls andprocedures to ensure that amounts outstanding from deceased estates are recovered in a timely manner; and(b) establish a policy on the accounting treatment of long outstanding amounts that are not recoverable.
Amend or derogate legislation that discriminates against women, and adopt measures to expedite the enactment of outstanding bills in this regard,such as the Gender Equality Bill, the Deceased Estates(Wills, Inheritance and Protections) Bill and the Marriage, Divorce and Family Relations Bill(Spain);
Ireland welcomed the adoption of the Prevention of Domestic Violence Act in 2006,as well as the provisions of the Deceased Estates Bill and the Marriage, Divorce and Family Relations Bills, and inquired about the date of their entry into force.

Parliamentarians have since been sensitized on all gender-related Bills including the one enacted into law in 2011, the Deceased Estates(Wills, Inheritance and Protection) Act which repealed the Wills and Inheritance Act.

The new Bill is called the Deceased Estate(Wills, Inheritance and Protection) Bill and has already been submitted to Cabinet and Parliament.

Government also recommended that as an exceptionto the discrimination rule, younger children should inherit a larger share of a deceased estate in keeping with the greater needs of a younger child.
