Report of the Secretary-General on the implementation of the Convention and other developments relating to ocean affairs and the law of the sea(resolution 49/28);
The overall framework provided by UNCLOS for action in the marine sector combined with the imperative of considering ocean issues“as a whole” point to the importance of monitoring and reviewing, in an integrated manner,developments pertaining to the implementation of UNCLOS as well as other developments relating to ocean affairs and the law of the sea.
Member States continue to request annual comprehensive reports on developments relating to ocean affairs and the law of the sea and periodical special reports on fisheries and other topics of current interest.
Decides to undertake an annual review andevaluation of the implementation of the Convention and other developments relating to ocean affairs and the law of the sea;
Reaffirms its decision to undertake an annual review andevaluation of the implementation of the Convention and other developments relating to ocean affairs and the law of the sea, taking into account resolution 54/33 establishing the consultative process to facilitate the review of developments in ocean affairs, and requests the Secretary-General to convene the second meeting of the Consultative Process in New York from 7 to 11 May 2001;

This special occasion has provided us with a precious opportunity to review and evaluate the implementation of the Convention,as well as the developments relating to ocean affairs over the past 20 years.
The final paragraphs of the draft resolution, concerning the annual review andevaluation by the General Assembly of the implementation of the Convention and other developments relating to ocean affairs and the law of the sea, make reference to the resolution to be adopted under sub-item 40(c), which will set out the modalities for an improved debate on this item next year.
In its resolution 49/28 of 1994, the Assembly decided to undertake an annual review andevaluation of the implementation of the Convention and other developments relating to ocean affairs.
The reports of the Secretary-General on oceans and the law of the sea serve as a basis for the annual review andevaluation of the implementation of the United Nations Convention on the Law of the Sea(UNCLOS) and other developments relating to ocean affairs and the law of the sea by the General Assembly, as the global institution with the competence to undertake such a review.
Mr. Iyambo(Namibia): It is now almost two years since the General Assembly, by its resolution 49/28 of 1994, decided to undertake an annual review andevaluation of the implementation of the United Nations Convention on the Law of the Sea and other developments relating to ocean affairs and the law of the sea.
In that respect, the role of the General Assembly as the global body having competence to undertake an overall review of the implementation of UNCLOS and other developments relating to ocean affairs and the law of the sea was particularly emphasized.
Another delegation pointed out that the General Assembly was the global forum with the mandate to undertake an annual substantive review andevaluation of the implementation of the Convention and other developments relating to ocean affairs and the law of the sea.
Moreover, the General Assembly, as the global institution having the competence to do so, decided to undertake an annual review andevaluation of the implementation of UNCLOS and other developments relating to ocean affairs and the law of the sea General Assembly resolution 49/28, preamble and para.12.
The present report is submitted to the General Assembly in accordance with its resolution 49/28 of 6 December 1994,in which it requested the Secretary-General to report to it annually on developments pertaining to the implementation of the United Nations Convention on the Law of the Sea and on other developments relating to ocean affairs and the law of the sea.
The General Assembly considers that the comprehensive annual report plays a critical role andconstitutes the basis for its annual review of all developments relating to ocean affairs and the law of the sea.
The draft resolution reaffirms the decision of the General Assembly to undertake an annual review andevaluation of the implementation of the Convention and other developments relating to ocean affairs and the law of the sea.
The draft resolution contains several paragraphs on new developments pertaining to the implementation of the Convention as well as other issues and developments relating to ocean affairs and the law of the sea.
The present report is divided into two main chapters: chapter I is devoted to developments pertaining to the implementation of the Convention andchapter II to other developments relating to ocean affairs and the law of the sea.
Its servicing of the General Assembly and its Consultative Process during their annual review andevaluation of the implementation of the Convention and other developments relating to ocean affairs has satisfied the users of the services.
The comprehensive annual report prepared by the Division(see paras. 10-11 above)is one of the main contributions of the Secretariat to the General Assembly's annual review of developments relating to ocean affairs and the law of sea.
Some delegations pointed out that the global forum having the mandate to undertake an annual substantive review andevaluation of the implementation of the Convention and other developments relating to ocean affairs and the law of the sea was the General Assembly.
In its annual resolutions on"Oceans and the law of the sea", the General Assembly continues to reaffirm the importance of the annual consideration and review of overall developments relating to ocean affairs and the law of the sea.
Other delegations indicated that the General Assembly was the global forum with the mandate to undertake an annual substantive review andevaluation of the implementation of the Convention and other developments relating to ocean affairs and the law of the sea.
The present report is submitted to the General Assembly in response to its resolution 49/28 of 6 December 1994, in which the Secretary-General was requested to report to the Assembly annually, as from its fiftieth session,on developments pertaining to the implementation of the United Nations Convention on the Law of the Sea and on other developments relating to ocean affairs and the law of the sea, as well as on the implementation of that resolution.
General Assembly resolutions 62/177 on sustainable fisheries and 62/215 on oceans and the law of the sea, adopted on 18 and 22 December 2007, respectively, cover a broad range of ocean issues and attest to the ever-increasing importance of the role of the General Assembly as the global institution having the competence to undertake an annual review andevaluation of the implementation of UNCLOS and other developments relating to ocean affairs and the law of the sea; a task the Assembly first set for itself in resolution 49/28.
It is intended to assist the General Assembly in its annual review andevaluation of the implementation of the Convention and other developments related to ocean affairs and the law of the sea.
