On 7 May 2009, the authors held a picket in front of the Internal Affairs Department of the Regional Executive Committee in Gomel city.

In his complaint, the author pointed out that he had specified the required details concerning the planning andconduct of the event in a written undertaking appended to his application to the Gomel City Executive Committee.
Therefore, the Gomel City Executive Committee had restricted his right of peaceful assembly without due justification.
The author and the other applicants complained about the decision of the Gomel City Executive Committee of 5 December 2007 to the Tsentralny District Court of Gomel. .
On 5 December 2007 the Gomel City Executive Committee denied authorization to hold the mass events, noting that the application did not contain the required details related to the planning and conduct of the events, in breach of article 5 of the Law on Mass Events.
Decision No. 299 replaced decision No. 318 of the Gomel City Executive Committee, which also restricted the right of assembly.
The Central Electoral Commission noted that the author had indicated in the questionnaire that he was working as a legal adviser for Lokon and concluded that this was only his secondary job,since the author's main place of work was the Civil Initiatives where he was heading the Gomel City Section.
The author reiterates that the Gomel City Executive Committee denied his request without any justification under article 21 of the Covenant.
On 12 February 2008,the author distributed leaflets containing information on the venue of a meeting in Gomel city with Mr. Milinkevich- a former candidate for the post of President of the Republic.
He adds that,on 2 April 2008, the Gomel City Executive Committee adopted decision No. 299 on mass events in Gomel, imposing a number of restrictions that apply to organizers of peaceful events other than city authorities.
The author has been a member of the United Civil Party since 2001 and, since 2002,the Chairperson of the Gomel City Section of the public association Civil Initiatives and a member of the Belarusian Association of Journalists.
The author, together with a group of Gomel city residents(hereinafter"the other applicants"), sought the authorization of the Gomel City Executive Committee to hold mass events in different parts of the city to protest against the abolition of social benefits to people in need.
Since 2001, he has been a member of the United Civil Party; since 2002,the Chairperson of the Gomel City Section of the public association Civil Initiatives and a member of the Belarusian Association of Journalists.
It reiterates the facts of the case and states that the Gomel City Executive Committee dismissed the author and the other applicants' complaints as the written undertaking enclosed with their applications to hold mass events did not contain all details required for the planning and conduct of such events.
The issue before the Committee is whether the denial of the required authorization of mass events that the author had planned with a group of Gomel city residents constitutes a violation of his rights under article 21 of the Covenant.
In case No. 1851/2008(Sekerko v. Belarus),the author and a group of Gomel city residents were denied authorization to hold mass events in different parts of the city to protest against the abolition of social benefits to people in need.
It further recalls that, according to the ruling of the Central Electoral Commission,the author has incorrectly indicated working as a legal adviser for Lokon rather than heading the Gomel City Section of the Civil Initiatives as his"main place of work" in the questionnaire.
The author maintains that,in the light of the above, the decision of the Gomel City Executive Committee of 2 April 2008 undermines the essence of the right provided for in article 21 of the Covenant and that he has been deprived of the right of peaceful assembly.
The authors claim that their right to freedom of expression and assembly under articles 19 and 21 of the Covenant had been restricted arbitrarily,since neither Decision No. 299 of the Gomel City Executive Committee nor the courts had provided any justification for the restriction of their rights, other than the formal application of the domestic law.
According to the ruling of the Gomel Regional Court, the Gomel City Executive Committee denied authorization to the author and the other applicants on the ground that the written undertaking appended to their application to hold events did not contain details related to their planning and conduct, which is a mandatory, essential condition for granting authorizations.
In particular, in addition to requiring prior authorization for all public gatherings and limiting the holding of such gatherings to one single location,Decision No. 299 of the Gomel City Executive Committee further requires organizers of public events to conclude contracts, at their own expense, with the departments of the interior-- to assure the protection of public order; with medical institutions-- to provide medical assistance; and with a cleaning enterprise, to ensure cleaning following the gathering.
The authors never requested permission, as,in accordance with the provisions of same Law, the Gomel City Executive Committee had issued Decision No. 299 of 2 April 2008("Regarding public gatherings in Gomel"), designating a single location in the outskirts of Gomel for the holding of public gatherings, but the authors did not wish to hold their picket there, as, according to them, it would have been meaningless.
