Access to information for persons having a legitimate interest.

Several delegations made proposals as to the definition of individuals having a legitimate interest.

Several delegations suggested that States parties should also be urged, in paragraph 3, to take the necessary measures to inform"individuals having a legitimate interest.
Article 16, paragraph 2, of the draft would make it incumbent on States to take measures to ensure that persons having a legitimate interest received information on the situation of persons deprived of liberty.
The request must be submitted by the close family or relatives of the disappeared person or their legal representatives, their counsel or any person authorized by them,as well as by any other person having a legitimate interest.
Any association, organization orother legal entity, having a legitimate interest in ensuring that these regulations are complied with, may engage itself either on behalf of or in support of the complainant, with his or her approval, in any judicial or administrative procedure which is provided for the enforcement of obligations under the regulations.
In promoting the right to the truth, States should guarantee broad legal standing in the judicial process to any wronged party andto any person or NGOs having a legitimate interest therein.
The information contained in these registers shall be made available to their family members, their counsel orto any other persons having a legitimate interest in the information, unless this would be detrimental to the wellbeing of the child, to any judicial or other competent and independent national authority and to any other competent authority seeking to trace the whereabouts of a detained person.
Accurate information on their detention and whereabouts, including transfers, shall be made promptly available to their family members and counsel orother persons having a legitimate interest in the information.
The Equal Treatment In Employment Regulations(Legal Notice 461 of 2004) states that nothing shall prevent any association orother legal entity having a legitimate interest in ensuring that these regulations are complied with, and to engage itself with the approval of the plaintiff on behalf or in support of the complainant, in any judicial or administrative procedure provided for the enforcement of the obligations emanating under these regulations.30.
Another proposal was to merge draft article 16, paragraph 2,on information relating to the situation of a person deprived of liberty that should be communicated to persons having a legitimate interest, with draft article 12.
With regard to active legal standing,it has been recommended that the remedy of amparo be granted to anyone having a legitimate interest in protecting the right affected by the administrative act, and that recognition be given to the public right of action exercisable by State agencies or private bodies for the protection of collective or broad interests associations, trade unions, chambers of commerce, non-governmental organizations, environmental organizations, etc.
The States Parties guarantee a broad legal standing in the judicial process to any wronged party, or any person or national orinternational organization having a legitimate interest therein.
Paragraph 2 provides that information on the place of detention of such persons“shall be made promptly available to their family members, their counsel orto any other persons having a legitimate interest in the information unless a wish to the contrary has been manifested by the persons concerned”.
Some delegations proposed that extension of the right to take proceedings before a court in order to determine the lawfulness of detention, guaranteed under the International Covenant on Civil and Political Rights, to families or persons having a legitimate interest must be limited to those cases in which there were grounds for believing that the person had been the victim of an enforced disappearance and not to any deprivation of liberty.
Parental and family involvement should be promoted, and accurate information on the detention of children and their place or places of detention, including transfers, shall be made promptly available to their family members, their counsel orto any other persons having a legitimate interest in the information.
Please note that you must have the authorization from the relatives of the disappeared person, their legal representatives, their counsel orany other person having a legitimate interest, to submit this request to the Committee on Enforced Disappearances.
Accurate information on the deprivation of liberty of any person and on his or her whereabouts, including information on any transfer, the identity of those responsible for the deprivation of liberty, and the authority in whose hands the person has been placed, shall be made immediately available tothe person's counsel or to any other persons having a legitimate interest in the information.
Judicial criminal proceedings, with a broad legal standing in the judicial process for any wronged party andto any person or non-governmental organization having a legitimate interest therein, are essential to ensuring the right to the truth.
The Working Group recalls articles 2("no State shall practise, permit or tolerate enforced disappearances"), 7("no circumstances whatsoever… may be invoked to justify enforced disappearances") and 10("accurate information on the detention of such persons and their place or places of detention, including transfers, shall be made promptly available to their family members, their counsel orto any other persons having a legitimate interest in the information") of the Declaration.
With regard to paragraph 1, several delegations proposed replacing the phrase"person able to claim a legitimate interest", which placed an undue burden on victims and family members of disappeared persons,with the phrase"person having a legitimate interest", which was more closely based on the text of the 1992 Declaration and the draft Convention of 1998.
This law may serve as an effective tool for tracing the whereabouts of persons deprived of their liberty, and is available not only to family members or their lawyers butalso to any other person having a legitimate interest in such information.
Another delegation suggested a compromise wording based on article 19, paragraph 2, of the Covenant, calling on States toguarantee respect for the freedom of family members and other persons having a legitimate interest to seek and receive information, as laid down in the instrument.
Canada supports the principles contained in this article and is of the view that a Stateshould make all reasonable efforts to communicate information about detained persons to family members and other persons having a legitimate interest in the information.
In accordance with article 30 of the Convention, either the relatives of a person who has reportedly been enforcedly disappeared, their legal representatives, their counsel or any other person authorized by them,as well as any other person having a legitimate interest, may submit to the Committee a request that a person be sought and found as a matter of urgency.
In addition to the consideration of State party reports and individual communications, the Committee on Enforced Disappearances can also consider requests submitted by relatives of disappeared persons,their legal representatives and others having a legitimate interest that a disappeared person be sought and found.
