Resolutions and decisions were also adopted on the question of arbitrary detention; torture and other cruel,inhuman or degrading treatment or punishment; human rights and states of emergency; the impunity of perpetrators of violations of human rights; independence and impartiality of the judiciary, jurors and assessors and the independence of lawyers; application of international standards concerning the human rights of detained juveniles; and the right to a fair trial. 2/.
The Special Rapporteur, while serving as an expert of the Sub-Commission on Prevention of Discrimination and Protection of Minorities and Special Rapporteur on the question of human rights and states of emergency, recommended in his annual report that a binding text should be drawn up to protect all individuals from enforced disappearance.
In its resolution 1996/30 of 29 August 1996, the Sub-Commission on Prevention of Discrimination and Protection of Minorities thanked Mr. Leandro Despouy, Special Rapporteur on human rights and states of emergency, for his ninth annual report which, after updating, would be submitted to the Commission on Human Rights for consideration at its fifty-third session.
In its resolution 1995/42, the Commission on Human Rights, endorsing Subcommission resolution 1994/36, recommended that the Economic and Social Council approve the request of the Subcommission to the Special Rapporteur on human rights and states of emergency to fulfil his mandate, notably relating to the holding of an expert meeting, inter alia to establish a database on states of emergency and related human rights questions.
Consideration should be given to the possibility of including the followingminimum standards of humanity in such a declaration: Cf. the eighth annual report of the Special Rapporteur on human rights and states of emergency, of 26 June 1995(E/CN.4/Sub.2/1995/20 and Corr.1), annex I Report of the Meeting of Experts on Rights not subject to Derogation during States of Emergency and Exceptional Circumstances.
