The Committee considered the initial report of Guatemala(CAT/C/12/Add.5 and 6) at its 232nd and 233rd meetings, on 16 November 1995(CAT/C/SR.232 and 233/Add.1 and 3), and has adopted the following conclusions and recommendations.
Mr. LALLAH said that the Committee was engaged in an experiment with respect to the initial report of Guatemala.
The Committee considered the initial report of Guatemala(CRC/C/3/Add.33) at its 306th to 308th meetings, on 3 and 4 June 1996(CRC/C/SR.306-308), and at its 314th meeting, on 7 June 1996, adopted the following concluding observations.
The Committee agreed, at the request of the Government concerned, to postpone the consideration of the initial report of Guatemala to its fifteenth session, in November 1995.
The Committee considered the initial report of Guatemala on articles 1 to 15 of the Covenant(E/1990/5/Add.24) at its 11th to 14th meetings on 7 and 8 May 1996 and, at its 26th meeting on 17 May 1996, adopted the following concluding observations.
The Committee agreed to schedule for consideration at its fifty-sixth session,to be held in New York from 18 March to 4 April 1996, the initial report of Guatemala, the second periodic report of Zambia, the third periodic reports of Peru and Mauritius and the fourth periodic report of Spain.

Considering the initial report of Guatemala, the Human Rights Committee noted its concern regarding cases of violence against the repatriated population, which had resulted in extrajudicial executions, disappearances, and torture or ill-treatment.
Under the rules laid down by the United Nations, the initial report of the State of Guatemala should have been submitted in 1993.
Replying to a question by Mr. KRETZMER,the CHAIRPERSON said that the reports in question were the initial report of Croatia, the second periodic reports of Guatemala and the Syrian Arab Republic, the third periodic report of Venezuela and the fourth periodic report of Yugoslavia.
During the consideration of Guatemala's initial report, the Committee had been sorry to find that the right to bear arms was written into the Constitution.

In accordance with resolution 1988/4 of theUnited Nations Economic and Social Council, the State of Guatemala was to submit its initial report within two years of the entry into force of the Covenant, which meant that this report should have been sent in September 1989.
As fully explained in the initial report submitted by the Government of Guatemala at the Committee's May 1995 session, Guatemalan legislation does not permit distinctions, exclusions, restrictions or preferences for individuals on the basis of race, colour, lineage or origin; this means that the country's legal system does not restrict the rights of any Guatemalan or foreigner, with the exceptions laid down by the law for certain cases.
Bearing in mind that, during the introduction of the initial report and the second periodic report, the representatives of Guatemala said that the process leading up to the formulation of the declaration under article 22 of the Convention had begun, a statement repeated during the consideration of the third report, Guatemala is invited to make the declaration in question" para. 75 d.
