It is in that period that the Special Representative has been obliged to express opinions concerning the human rights implications of highly charged political events in Cambodia that appear to have occasioned the difficulties that have arisen which must, in candour,be referred to in this report.
At its first session, the Working Group adopted its programme of work(see annex III). While many situations referred to in this report address the period immediately after a conflict,in which"external assistance is most crucial in supporting or underpinning still fragile cease-fires or peace processes by helping to create the conditions for political stability, security, justice and social equity", this report uses the term in a broader context, covering also situations where conflict still rages or where peacebuilding and reconstruction are already at an advanced stage.
The International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991,established by Security Council resolution 827 of 25 May 1993 will be referred to in this report as the"International Criminal Tribunal for the former Yugoslavia.
As regards the access to justice for the victims or their relatives, the Special Rapporteur recommends thatthe Indonesian authorities apply, in addition to the various international principles referred to in this report, the following points embodied in the Declaration of Basic Principles of Justice for Victims of Crime and Abuse of Power, adopted by the General Assembly in its resolution 40/34 of 29 November 1985.
The Security Council would encourage further donations to the Trust Fund to Support Initiatives of States Countering Piracy off the Coast of Somalia, including from the shipping industry and flag States, so that the proposed assistance by UNDP andUNODC to regional States referred to in this report can go ahead as planned;
