If the distinction between injured and interested States were to be maintained,this draft article should list all the remedies that the State entitled to invoke responsibility may seek from the responsible State, so as to establish clearly the contrast with the list in draft article 49 2.
The best solution would be to delete the brackets and replace"and" by"or", on condition that a provision was added stating that, if the State in which thecorporation was formed and the State in whose territory it had its registered office were different, the State entitled to exercise diplomatic protection on its behalf would be the one with which the corporation had the closest connection.
The Netherlands agreed with the Special Rapporteur that draft article 3 should be amended to read"the State of nationality is the State entitled to exercise diplomatic protection", as that formulation properly emphasized the bond of nationality between State and national which entitled the State to exercise diplomatic protection.
