This action, in our view, is an insult to the United Nations since Security Council resolutions categorically condemned the declaration of the purported secession of part of the Republic of Cyprus, considered such declaration as legally invalid andcalled for its withdrawal and upon all States not to recognize any Cypriot state other than the Republic of Cyprus Council resolution 541(1983) of 18 November 1983.
The resolutions also called on all states not to recognize the purported state and not to facilitate or in any way assist it.
The Court notes that the argument of Portugal under consideration rests on the premise that the United Nations resolutions, and in particular those of the Security Council,can be read as imposing an obligation on States not to recognize any authority on the part of Indonesia over the Territory and where the latter is concerned, to deal only with Portugal.

In reaction to the unilateral declaration of independence in 1983 by the then leader of the Turkish Cypriot community, the Security Council of the United Nations adopted Resolution 541(1983)which"Calls upon all States not to recognize any Cypriot State other than the Republic of Cyprus…," while subsequent Resolution 550(1984)"Condemns all secessionist actions… declares them illegal and calls for their immediate withdrawal.
The Council also called upon all States not to recognize the purported state of the so-called Turkish Republic of Northern Cyprus and not to facilitate or in any way assist the aforesaid secessionist entity.
In its relevant resolutions, the most recent ofwhich was resolution 57/5, the General Assembly has expressed its grave concern over the negative impact of unilateral extraterritorial coercive measures and called upon all States not to recognize or apply unilateral extraterritorial coercive economic measures imposed by any State that are contrary to recognized principles of international law.

It should be noted that, in these resolutions, the Security Council considered, inter alia, the declaration which purported to create"an independent State" in northern Cyprus legally invalid,called for its withdrawal, and called upon all States not to recognize the purported State of the"Turkish Republic of Northern Cyprus" set up by secessionist acts and not to facilitate or in any way assist the aforesaid entity.
Moreover, the United Nations condemned all secessionist acts and called upon all States not to recognize, facilitate or in any way assist the illegal entity; demanded the return of the internally displaced persons to their homes in safety, as well as the tracing and accounting of the missing persons; and called for respect of the human rights of the Cypriots.
The General Assembly had adopted numerous resolutions, the most recent being resolution 53/10of 26 October 1998, urging all States not to recognize or apply extraterritorial coercive economic measures or legislative enactments unilaterally imposed by any State and calling for the immediate repeal of any such measures that had been imposed on developing countries.
The Assembly called for the immediate repeal of unilateral extraterritorial laws that imposed sanctions on companies and nationals of other States; called upon all States not to recognize unilateral extraterritorial coercive economic measures or legislative acts imposed by any State; and requested the Secretary-General to submit to the Assembly at its fifty-second session a report on the implementation of the resolution resolution 51/22.
This act of purported secession was condemned by the Security Council; in its resolution 541(1983),the Council considered the said declaration as legally invalid and called upon all States not to recognize any Cypriot State other than the Republic of Cyprus, while, in its resolution 550(1984), the Council expressed grave concern about the secessionist acts in the occupied part of the Republic of Cyprus and called upon all States not to facilitate or in any way assist the aforesaid secessionist entity.
