It would be appropriate to retain the categories which the Commission had adopted for the codification of the law of succession in respect of matters other than treaties, rather than those which it had adopted for succession in respect of treaties.
The Commission endorsed the broad outline, the order of priority of the headings and the division of the topic recommended by the Subcommittee,namely: succession in respect of treaties, succession in respect of rights and duties resulting from other sources than treaties(revised in 1968 to read"Succession in respect of matters other than treaties") and succession in respect of membership of international organizations.
The Court's Judgment not only draws on treaties concluded pursuant to the Commission's proceedings- those onthe law of treaties, of State succession in respect of treaties, and the law of international watercourses; it also gives great weight to some of the Commission's draft articles on State responsibility, as did both Hungary and Slovakia in their pleadings.
We know that the International Law Commission undertook the process of codification in relation to State succession separately,establishing a distinction between succession in respect of treaties and succession in respect of non-treaty rights and obligations. Accordingly, those initial instruments-- as their titles.
The Special Rapporteur noted that the codification, in the next two Vienna Conventions,of the law of treaties concluded by international organizations and on State succession in respect of treaties had had implications for the definition of reservations itself art. 2, para. 1(d), of the 1986 Vienna Convention and art. 2, para. 1(j), of the 1978 Convention.
