Education measures to benefit indigenous peoples should respect their right to selfdetermination.

The Court also notes that the principle of selfdetermination of peoples has been enshrined in the United Nations Charter and reaffirmed by the GeneralAssembly in resolution 2625(XXV) cited above, pursuant to which"Every State has the duty to refrain from any forcible action which deprives peoples referred to[in that resolution]. of their right to selfdetermination.
However, today we must question the nature of the obstacles that still prevent us from reaching a lasting and comprehensive solution,mainly to enable the Palestinian people to exercise their right to selfdetermination as enshrined in the Charter, which necessitates implementing the resolutions and respecting the provisions of international law.
Indigenous peoples as a specific form of exercising their right to selfdetermination, have the right to autonomy or self-government in matters relating to their internal and local affairs, including culture, religion, education, information, media, health, housing, employment, social welfare, economic activities, land and resources management, environment and entry by non-members, as well as ways and means for financing these autonomous functions" emphasis added.
The delegation of Guatemala fully and unrestrictedly recognizes the identity of indigenous peoples and their individual and collective rights, including their right to selfdetermination, and has done so at the national level in the Agreement on the Identity and Rights of the Maya, Xinca and Garífuna Peoples in the context of the Peace Agreements.
Mr. Al-Jarman(United Arab Emirates)(spoke in Arabic): I am pleased that we meet each year at this time to mark the International Day of Solidarity with the Palestinian People and to renew our commitment to the realization of the inalienable rights of the Palestinian people,in particular their right to selfdetermination and their right to establish an independent State, like other peoples.
Thus, in 1965, it adopted resolution 2105(XX) in which it"[r]ecognize[d]the legitimacy of the struggle of colonial peoples against colonial rule to exercise their right to selfdetermination and independence", while in 1972, it adopted resolution 2936(XXVII) in which it reaffirmed"its recognition of the legitimacy of the struggle of colonial peoples for their freedom by all appropriate means at their disposal.
Ms. Barghouti(Observer for Palestine)expressed appreciation to the members of the Committee and the observers for their constant support for the realization of the inalienable rights of the Palestinian people, including their right to selfdetermination, independence and statehood, and for the establishment of a just and lasting peace in the Middle East.
Mr. Palavicini-Guédez(Bolivarian Republic of Venezuela) expressed his delegation's solidarity with the people of Western Sahara, andits hope that the latter would be able to exercise their right to selfdetermination, pursuant to the relevant General Assembly and Security Council resolutions, and be able to participate fully as an independent nation in the work of the international community.
There are numerous reasons for this failure, including the continued occupation of the Palestinian and other Arab territories by the Zionist regime andits persistent violations of the rights of the Palestinian people, including their right to selfdetermination and especially the legitimate and inalienable right of the Palestinian refugees to return to their homeland.
I have doubts whether the last part of that finding is correct(see para. 32, below), butit is beyond doubt that the mere existence of a structure that separates the Palestinians from each other makes the realization of their right to selfdetermination far more difficult, even if it has to be admitted that the realization of this right is more dependent upon political agreement than on the situation in loco.
