For example, while the Convention stressed that important social rights such as the rights to  social security, health care andeducation were applicable to irregular migrants, the scope of some of those rights in the Convention appeared narrower than in more general international human rights instruments as interpreted by the competent treaty bodies.
Protection was afforded under Protocol 1 to  the European Convention, guaranteeing the right to  free education for all children, and under the European Social Charter, which,though not applicable to irregular migrants as a general rule, had been successfully invoked in some cases.
In particular, it states that improving further the process of disseminating information on voluntary return to irregular migrants is essential in order to  ensure that they have access to  accurate information even where they are more likely to  rely primarily on informal sources of information from within their community but also when the former is unwilling to  return and/or is mistrustful of migration authorities.
While recognizing the serious challenges that migratory flows present to  State mechanisms, the CoE Commissioner remained very concerned about new legislative measures on immigration and asylum which had been adopted orwere under consideration, such as those criminalizing the letting of accommodation to irregular migrants and the decision to  lift the ban on doctors to  report to  the authorities irregular migrants  who access the health system.
