FURTHER RECALLING the relevant provisions of the United Nations Agreement to Implement the relevant provisions of the 1982 Law of the Sea Convention relating to straddling fish stocks and highly migratory fish stocks, and in particular Articles 5 and 6;
With respect to straddling fish stocks, the relevant coastal State(s) and States whose nationals fish for such stocks in the adjacent high seas area shall seek, either directly or through the appropriate mechanisms for cooperation provided for in section IV, to agree upon the measures necessary for the conservation of these stocks in the adjacent high seas areas;
We will have gone a long way towards achieving that objective in this Conference if we agree upon concrete measures that translate into strong and sound fisheries conservation andmanagement practice by all States in all areas with respect to straddling fish stocks and highly migratory fish stocks.
Coastal States and States fishing on the high seas shall, in accordance with the Convention,pursue cooperation in relation to straddling fish stocks and highly migratory fish stocks directly or through appropriate subregional or regional fisheries management organizations or arrangements, taking into account the specific characteristics of the subregion or region.
The present paper, prepared upon the request of the United Nations Conference on Straddling Fish Stocks and Highly Migratory Fish Stocks, intends to clarify the concept of precaution andits implications in fisheries with particular reference to straddling fish stocks and highly migratory fish stocks.
Coastal States and States fishing on the high seas shall, in accordance with the Convention,pursue cooperation in relation to straddling fish stocks and highly migratory fish stocks bilaterally and/or multilaterally through regional fisheries management organizations or consultative arrangements, taking into account the specific characteristics of the region or subregion.
The Review Conference reaffirm the fundamental principle of compatibility contained in the United Nations Convention on the Law of the Sea and set out in article 7 of the Agreement, with specific reference to the high seas andthe necessity of not applying measures in the high seas that might undermine the efficacy of the measures applied to straddling fish stocks and highly migratory fish stocks by the coastal State.
With respect to straddling fish stocks, no requirement for a minimum portion of fish occurring outside or inside areas under national jurisdiction has been defined, but according to usage, straddling is considered to include situations where there is some directed fishing effort at catching the stock on either side of the boundary.
Strengthen efforts to improve cooperation between flag States whose vessels fish on the high seas and coastal States so as to ensure compatibility of measures for the high seas andfor areas under national jurisdiction with respect to straddling fish stocks and highly migratory fish stocks in accordance with article 7 of the Agreement and relevant provisions of the Convention;
Coastal States and States fishing on the high seas shall,in accordance with the Convention, pursue cooperation in relation to straddling fish stocks and highly migratory fish stocks either directly or through appropriate subregional or regional fisheries management organizations or arrangements, taking into account the specific characteristics of the subregion or region, to ensure effective conservation and management of such stocks.
