National provisions to be adopted pursuant to this Directive.

(b) Member States shall take the measures needed to ensure that suppliers and operators of means of communication, where they are able to do so,cease practices which do not comply with measures adopted pursuant to this Directive.
(20) An operator should not be required to bear the costs of preventive orremedial actions taken pursuant to this Directive in situations where the damage in question or imminent threat thereof is the result of certain events beyond the operator's control.
Whereas, in any event, transfers to third countries may only be effected in fullcompliance with the provisions adopted by the Member States pursuant to this Directive, and in particular Article 8 thereof;
Protection pursuant to this Directive as regards copyright shall also be available in respect of databases created prior to the date referred to[in] Article 16(1) which on that date fulfil the requirements laid down in this Directive as regards copyright protection of databases.
Member States may provide that the undertakings referred to in paragraph 2 shall comply with the accountingrules governing assurance undertakings authorised pursuant to this Directive for all of their activities.

The provisions of Chapter III on judicial remedies, liability and sanctions of Directive[95/46]shall apply with regard to national provisions adopted pursuant to this Directive and with regard to the individual rights derived from this Directive. .
Undertakings authorised pursuant to Article 6 of Directive 73/239/EEC solely for the risks listed in classes 1 and2 in the Annex to that Directive may obtain authorisation pursuant to this Directive.
The provisions of Chapter III on judicial remedies, liability and sanctions of Directive 95/46/EC shallapply with regard to national provisions adopted pursuant to this Directive and with regard to the individual rights derived from this Directive. .
Member States shall require that obliged entities take measures proportionate to their risks,nature and size so that their employees are aware of the provisions adopted pursuant to this Directive, including relevant data protection requirements.
Member States shall provide that any person who has suffered damage as a result of an unlawful processing operation orof any act incompatible with the national provisions adopted pursuant to this Directive is entitled to receive compensation from the controller for the damage suffered.
