Annex II- List of open points.
The number of open points remains significant 4.19.
These are known as open points.
These open points can have a potential financial impact.
National rules applicable to the open points.
These open points can have a potential financial impact and are closed when appropriately addressed by the Member States.
The Commission services follow up‘open points' in a timely and prompt manner.
The Commission's inspections in Member States result in findings,so-called‘open points'(38).
Formal project status reporting and tracking of the open points and assigned task s status to customer and management are a must.
(31) A total of 29 inspection reports were issued during 2013 which led to 98 new‘open points'.
As required in Articles 5(6) and 17(3)of Directive 2008/57/EC, open points shall be addressed by the application of national technical rules.
(38) A total of 28 inspection reports were issued during 2014 which led to 89 new‘open points'.
At the end of 2015, the Commission also had a list of 325 open points concerning non-compliance with EU customs rules that they had identified through inspections in Member States.
In accordance with Article 17 of Directive 96/48/EC technical aspects which are not covered are identified as‘Open Points' in Annex L of this TSI.
The table hereunder summarises the open points of this TSI and classifies each of them if related(column“YES”) or not(column“NO”) to technical compatibility between infrastructure and vehicles.

(1) With regard to those issues classified as‘Open points' set out in Annex L of the TSI, the conditions to be complied with for the verification of the interoperability pursuant to Article 16(2) of Directive 96/48/EC shall be those applicable technical rules in use in the Member State which authorise the placing in service of the subsystems covered by this Decision.
If certain technical aspects corresponding to the essential requirements cannot be explicitly covered in a TSI,they shall be clearly identified in an annex to the TSI as open points.

Vehicles which are in full compliance with the TSIs covering all aspects of the subsystems concerned without specific cases and open points strictly related to technical between vehicle and network compatibility are subject to no additional permissions to be commissioned, provided that they circulate on networks conforming to TSIs or the conditions specified in the TSIs corresponding.
Technical compatibility between the vehicle and the network concerned,including the national rules applicable to the open points needed to ensure such compatibility.

In accordance with Article 17 of Directive 2001/16/EC, and Article 17 of Directive 96/48/EC,technical aspects which are not covered are identified as‘Open Points' in Annex C of this TSI.
In accordance with Article 16(3) of Directive 96/48/EC, Member States shall notify to the Commission andother Member States a list of their national technical rules relating to the‘Open Points' and the procedures to be used for their conformity assessment.
In accordance with Article 17 of Directive 2001/16/EC, and Article 17 of Directive 96/48/EC, both as modified by Directive 2004/50/EC,technical aspects which are not covered are identified as‘Open Points' in Annex L of this TSI.
In accordance with Article 16(3) of Directive 96/48/EC, Member States shall notify to the Commission andother Member States a list of their national technical rules relating to the‘Open Points' and the procedures to be used for their conformity assessment.
This open point is related to the interface between ETCS on-board and driver, i.e.
Braking aspects This open point will be solved by ERTMS/ETCS baseline 3.
Requirements related to health, safety andergonomics are an open point.
