THE PROVISIONS CONCERNING THE PROGRESSIVE ABOLITION OF CUSTOMS DUTIES ON IMPORTS SHALL ALSO APPLY TO CUSTOMS DUTIES OF A FISCAL NATURE.
Whereas the objectives of the Community include contributing to the harmonious development of world trade and to the progressive abolition of restrictions on international trade;
Such agreements orcontracts shall be directed towards the progressive abolition of any discrimination in the application of these provisions to the various producers within the Community.
On the basis of a report from the Commission, the Council shall review the abovementioned reduced rates and exemptions every five years and, acting unanimously on a proposal from the Commission,shall where appropriate, adopt the measures required to ensure the progressive abolition thereof.

(f) by effecting the progressive abolition of restrictions on freedom of establishment in every branch of activity under consideration, both as regards the conditions for setting up agencies, branches or subsidiaries in the territory of a Member State and as regards the conditions governing the entry of personnel belonging to the main establishment into managerial or supervisory posts in such agencies, branches or subsidiaries;
That provision thus appears to be the necessary corollary to Article 13 of the Association Agreement, andconstitutes the indispensable precondition for achieving the progressive abolition of national restrictions on freedom of establishment(Tum and Dari, paragraph 61, and the case-law cited).

How this works is set out thus:“to contribute, in the common interest,to the harmonious development of world trade, the progressive abolition of restrictions on international trade and on foreign direct investment, and the lowering of customs and other barriers'”.

By establishing a customs union between themselves the Member States intend to contribute, in conformity with the common interest,to the harmonious development of world trade, the progressive abolition of restrictions on international exchanges and the lowering of customs barriers.
(f) by effecting the progressive abolition of restrictions on freedom of establishment in every branch of activity under consideration, both as regards the conditions for setting up agencies, branches or subsidiaries in the territory of a Member State and as regards the subsidiaries in the territory of a Member State and as regards the conditions governing the entry of personnel belonging to the main establishment into managerial or supervisory posts in such agencies, branches or subsidiaries;
Including such professions in the general system for the recognition of diplomas is not contrary to Article 47(3) EC,which states that the progressive abolition of restrictions on the right of establishment must be preceded or accompanied by a correlating coordination of the conditions for the exercise of those professions.
By effecting the progressive abolition of restrictions on freedom of establishment in every branch of activity under consideration, both as regards the conditions for setting up agencies, branches or subsidiaries in the territory of a Member State and as regards the subsidiaries in the territory of a Member State and as regards the conditions governing the entry of personnel belonging to the main establishment into managerial or supervisory posts in such agencies, branches or subsidiaries;

By establishing a customs union in accordance with Articles 28 to 32, the Union shall contribute, in the common interest,to the harmonious development of world trade, the progressive abolition of restrictions on international trade and on foreign direct investment, and the lowering of customs and other barriers.
In the case of the CCP, these can be found in Art. 206 TFEU, which states that“the Union shall contribute, in the common interest,to the harmonious development of world trade, the progressive abolition of restrictions on international trade and on foreign direct investment, and the lowering of customs and other barriers.”.
The Court also points out that the Association Council, which,in accordance with the Additional Protocol, is required to determine the timetable and rules for the progressive abolition of restrictions on freedom of establishment, has not, to date, adopted any measure which would suggest that substantive progress has been achieved towards the realisation of such freedom.
By establishing a customs union in accordance with Articles 23[28] to 27[32], between themselves Member States aim to the Union shall contribute, in the common interest,to the harmonious development of world trade, the progressive abolition of restrictions on international trade and on foreign direct investment, and the lowering of customs and other barriers.
