(15a) The enforcement authorities must apply dissuasive and proportionate penalties on those who violate the rules laid down in this Directive.
Dissuasive, effective and proportionate penalties, including financial ones, should be provided for by Member States against those air carriers and against non-carrier economic operators failing to meet their obligations regarding the transfer of PNR data and the protection of that data.
