D actions brought against the Commission under the ECSC Treaty by undertakings or associations of undertakings; and.
Undertakings or associations referred to in Article 48 may. under the same conditions, institute proceedings against decisions or recommendations.

Before taking decisions pursuant to Article 11 or 16,the Commission shall give the undertakings or associations of undertakings concerned the opportunity of being heard on the matters to which the Commission takesor has taken objection.
The Honourable MP is referred to Article 3 of Regulation 17 of the Council that where the Commission finds that there is an infringement of Article 85 or Article 86 of the Treaty it may by decision require the undertakings or associations of undertakings concerned to bring such an infringement to an end.
The Commission may by decision impose on the persons referred to in Article 3(1)(b), undertakings or associations of undertakings concerned periodic penalty payments of up to ECU 25 000 for each day of delay calculated from the date set in the decision, in order to compel them.
As regards the admissibility of actions against Commission decisions under the ECSC Treaty, the Court of First Instance found, in two orders of 29 September185, that a physical or legal person other than undertakings or associations of undertakings may not institute proceedings under Article 33 of the ECSCTreaty.
However, this provision shall not have effect where the Commission has informed the undertakings or associations of undertakings concerned that, after preliminary examination, it is of the opinion that Article 85(1) of the Treaty applies and that application of Article 85(3) is not justified.
Whereas, in order to carry out its duty of ensuring that the provisions ofthe Treaty are applied, the Commission must be empowered to address to undertakings or associations of undertakings recommendations and decisions for the purpose of bringing to an end infringements of Articles 85 and 86;
Upon application by the undertakings or associations of undertakings concerned, the Commission may certify that, on the basis of the facts in its possession, there are no grounds under Article 85(1) or Article 86 of the Treaty for action on its part in respect of an agreement, decision or concerted practice.
The text of the Decision refers in particular to the measures provided for by Article 19(1) of Regulation(EEC)No 4056/86 if undertakings or associations of undertakings refuse to submit to an investigation ordered by decision issued pursuant to Article 18 3.
The exemption provided for in Article 1(d)shall not benefit undertakings or associations of undertakings which concertor undertake among themselves, or oblige other undertakings, not to apply models illustrating the benefits of an insurance policy other than those established pursuant to an agreement between the participating undertakings. .

A transmission of a case may not take place after the publishing of the intention to give a negative clearance, the publishing of the intention to take a decision in application of Article 53(3) of the Agreement,the addressing to undertakings or associations of undertakings concerned of the statement of objectionsor the sending of a letter informing the applicant that there arc insufficient grounds for pursuing the complaint.
The exemption provided for in Article 1(c)shall not benefit undertakings or associations of undertakings which agree,or agree to oblige other undertakings, not to apply conditions other than standard policy conditions established pursuant to an agreement between the participating undertakings. .
In order to carry out its duty of ensuring that the provisions of this Regulation are applied,the Commission must be empowered to address to undertakings or associations of undertakings recommendations and decisions for the purose of bringing to an end infringements of the provisions of this Regulation prohibiting certain agreements, decisions or practices;
The Court has had occasion to observe that such parties concerned are any persons, undertakings or associations whose interests might be affected by the granting of aid, that is, in particular competing undertakings and trade associations Commission v Sytraval and Brink's France, paragraph 41, and Commission v Aktionsgemeinschaft Recht und Eigentum, paragraph 36.
The‘parties concerned' for the purposes of Article 88(2)EC who are entitled under the fourth paragraph of Article 230 EC to institute proceedings for annulment are any persons, undertakings or associations whose interests may be affected by the grant of aid, in particular undertakings competing with the recipients of the aid and trade associations Commission v Sytraval and Brink's France, paragraph 72 above, paragraph 41, and Commission v Aktionsgemeinschaft Recht und Eigentum, paragraph 72 above, paragraphs 35 and 36.
