Proposal relating to: Veterinary and zootechnical checks applicable in intra-Community trade in certain live animals adopted on 12.06.1992 COM(92) 147 final.
The Council, in accordance with the commitment taken in December 1989 at the time of the adoption of Council Directive 89/662/EEC,adopted Directive 90/425/EEC concerning veterinary and zootechnical checks applicable In intraCommunity trade in certain live animals and products with a view to the completion of the internal market summary 1.53.
The Directive of 26 June concerning veterinary and zootechnical checks applicable in intraCommunity trade in certain live animals and products with a view to the completion of the internal market extended the rules and principles adopted by the Council for animal products in Directive 89/662/EEC,' by adapting them for ap plication to live animals and certain products affected by animal diseases.
Failure of a Member State to fulfil its obligations- Failure to have transposed Council Directive 90/425/EEC concerning veterinary and zootechnical checks applicable in intraCommunity trade in certain live animals and products with a view to the completion of the internal market.
COUNCIL DIRECTIVE of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market 90/425/EEC.
For the purposes of this Directive, the definitions contained in Article 2 of Council Directive 89/662/EEC of 11 December 1989 concerning veterinary checks in intra-Community trade with a view to the completion of the internal market(5) andArticle 2 of Council Directive 90/425/EEC concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market(6) shall apply as necessary.
Having regard to Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market(1), as last amended by Directive 92/118/EEC 2.
Competent authority" means the competent authority within the meaning of Article 2(6) of Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market(9);
Pursuant to Article 3(1)(c)of Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market(3), animals for intra-Community trade have to be identified in accordance with the requirements of Community rules and be registered in such a way that the original or transit holding, centre or organisation can be traced.
Competent authority': the competent authority within the meaning of Article 2(6)of Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market 9.

COUNCIL DIRECTIVE 92/60/EEC of 30 June 1992 amending Directive 90/425/EEC concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market.
Whereas, pursuant to the fourth subparagraph of Article 21 of Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market(6), these must be included in the scope of Directive 89/662/EEC and of the said Directive the animals and products of animal origin not covered by the said Directives.
Whereas Council Directive 89/662/EEC of 11 December 1989 concerning veterinary checks in intra-Community trade with a view to the completion of the internal market(3) andCouncil Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and animal products with a view to the completion of the internal market(4), put the responsibility on the Member State of production or dispatch to ensure that veterinary checks, and where applicable, certification, are carried out in an appropriate manner;
Whereas Article 23 of Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market(3) provides, in particular, that the Council must lay down the rules and general principles applicable to checks on imports from third countries of animals covered by the said Directive;
At the time of the facts in the main proceedings, Community law, and more particularly Directive 91/68 andArticle 10 of Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market, did not preclude a Member State from imposing a requirement under national law such as Italian Order No 600.3/VET/340/2/8920 of 24 December 1996, as clarified by Explanatory.
For the purposes of this Directive the definitions in Article 2 of Directive 89/662/EEC andDirective 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market(7), and the definition of fresh meat in Article 2(b) of Council Directive 64/433/EEC of 26 June 1964 on health problems affecting intra-Community trade in fresh meat(8), shall apply as necessary.
