Ornamental aquatic animals as defined in point(k)of Article 3 of Directive 2006/88/EC and excluded from the scope of that Directive by point(a) of Article 2(1) thereof.
While Article 1(1) of Directive 93/13 defines the scope of that directive, Article 1(2) thereof provides that terms which reflect mandatory statutory or regulatory provisions are excluded.
It follows that the situation of a third country national who has made such an application falls outside the scope of that directive, as defined in Article 1 thereof.

Since further amendments,strictly limited to the extension of the scope of application of that Directive to include all energy-related products, are to be made,that Directive should be recast in the interests of clarity.
