The Control Copy T5 shall be issued by the intervention agency which sends the products and shall show one of the following endorsements in box 104.
As appropriate, a copy of the Control Copy T No 5 referred to in Article 4.
Where the control copy or the national document has been issued by way of proof that the products have left the customs territory of the Community.
Among the special endorsements on the control copy, the following shall be completed.
A copy of control copy T5 can only be issued upon presentation of the original or a copy of the related Community import licence.
The person concerned shall make out the control copy T 5 in one original and two copies. .
The control copy Τ 5 shall accompany the goods as far as the competent office where the customs formalities are carried out which enable the transferee to take charge of the goods.

Article 3 1.(a) The control copy T 5 referred to in Article 2(3) shall be issued by.
Where an extract of a licence or certificate, a replacement licence or certificate, or a replacement extract is used, the number of the original licence orcertificate shall be inserted in section 106 of the control copy T 5.
The total number of packages covered by the control copy T5 and the T5 bis continuation forms shall be shown in box 6 of the control copy T5.

Where products pursuant to Council Regulation(EEC) No 1055/77(16) are stocked in a Member State other than that where the selling intervention agency is situated,the selling intervention agency shall issue the control copy T 5 or have it issued under its responsibility.
In that case the person concerned shall make the following entry in box 106 of the control copy T 5:'Refund to be paid by. indicating the full name and address of the authority competent for payment of the refund.
Where that Annex refers to the single administrative document or to the document proving the Community status of the products as mentioned in Article 2(4) of Regulation(EEC) No 569/88,the reference shall be construed as to the control copy T 5.
Control copy T5 may also be produced and completed using an automatic reproduction process provided that the provisions as regards the specimens, the paper, the size, the language used, the legibility, the prohibition of erasures and overwriting and amendments are strictly observed.
Such proof shall be furnished by the following endorsement,certified by the competent authority, on the control copy referred to in Article 6 of Regulation(EEC) No 3665/87, the single administrative document or the national document proving that the goods have left the customs territory of the Community.
When delivery by tanker or container takes place in a Member State other than the producer Member State,proof of delivery under administrative supervision as referred to in Article 12 shall be furnished by production of the control copy referred to in Articles 471 to 495 of Commission Regulation(EEC) No 2454/9317.
Such proof shall be provided by the following indication,certified by the competent authority, on the control copy referred to in Article 6 of Regulation(EEC) No 3665/87 and of the single administrative document or national document proving that the goods have left the customs territoroy of the Community.
Where one of the processes referred to in Article 2(2) is carried out in a Member State other than that which recognized the producers' organization selling the product,proof that such processing has taken place shall be provided in the form of Control Copy T No 5 in accordance with the provisions of Commission Regulation(EEC) No 223/77(2) and of this Regulation.
Where the authorities provide this information by means of a control copy T 5 as referred to in Article 472 of Regulation(EEC) No 2454/93 and issued for the purpose of obtaining proof of departure from the Community's customs territory, the number of the original licence or certificate shall be inserted in section 105 of the control copy T 5.
Where goods intended for export to another Member State are dispatched under Community transit procedure to a Swiss orAustrian office of destination from which they will be dispatched to that other Member State, the control copy, by way of derogation from Article 12(3) of Regulation(EEC) No 223/77, shall accompany the goods to the competent customs office of the Member State of destination.
Such supporting documents must bear a reference to the control copy T 5 and include confirmation from the competent control authority that verified the use of the products, or had it verified, that the specified use was complied with indicating the date on which the products have received the use and/or destination.
The competent authorities of each Member State may allow undertakings established in their territory to supplement a control copy T5 with one or more continuation forms T5 bis in cases where all the forms relate to a single consignment of goods, loaded on a single means of transport and destined for a single consignee and a single use and/or destination.
Where only a part of the products mentioned in the control copy T 5 has complied with the prescribed provisions, the competent authority shall indicate in the section of the control copy T 5 headed'Control of use and/or destination' the quantity of products that complied with these provisions, and also the date or dates on which the operation was carried out.
The competent authorities of each Member State may allow undertakings established in their territory to supplement a control copy T5 with one or more continuation forms T5 bis in cases where all the forms relate to a single consignment of goods, loaded on a single means of transport and destined for a single consignee and a single use and/or destination.
Whereas the experience gained since the entry into force of Regulation( EEC) No 2290/83 has shown that the phrase to be entered on Control Copy T No 5 does not correctly inform the customs authorities of the Member State of destination of their obligation to ensure that the organization receiving the instrument or apparatus will use it in accordance with the conditions laid down for the continued grant of relief of customs duty; whereas that phrase ought therefore to be amended;
